Emergency Services and Disaster Law; limitation on duration of executive orders.

Emergency Services and Disaster Law; limitationon duration of executive orders. Limits the duration of any executiveorder issued by the Governor pursuant to his powers under the EmergencyServices and Disaster Law to no more than 45 days from the date ofissuance. The bill provides that if the General Assembly does nottake any action on the rule, regulation, or order within the 45 daysduring which the rule, regulation, or order is effective, the Governorshall thereafter be prohibited from issuing the same or a similarrule, regulation, or order relating to the same emergency. Under current law, once issued, such executive orders are effective untilJune 30 following the next regular session of the General Assembly.

Law-enforcement officer; use of deadly force during an arrest or detention.

Use of deadly force by a law-enforcement officerduring an arrest or detention. Eliminates the requirements thata law-enforcement officer shall not use deadly force against a personunless he has provided a warning to the subject of the deadly forcethat he will use deadly force, if feasible, and exhausted all otheroptions or such options do not reasonably lend themselves to thecircumstances. The bill shifts these requirements to the factorsconsidered in determining whether a law-enforcement officer's useof deadly force was proper.

Law-enforcement civilian oversight bodies; person appointed shall be U.S. citizen, etc.

Law-enforcement civilian oversight bodies.Provides that any person appointed to a law-enforcement civilianoversight body shall be a citizen of the United States, shall residein the jurisdiction that he is appointed to serve, shall not havea criminal record, and shall be required to complete (i) a Citizen's Law Enforcement or Police Academy with a basic firearms instructioncourse conducted by an accredited law-enforcement agency and (ii)one daytime and one nighttime ride-along with each agency that servesunder the authority of the locality. The bill requires at least twomembers of a law-enforcement civilian oversight body to have specialized knowledge in law-enforcement activities or operations. The bill providesthat a law-enforcement civilian oversight body shall not have theauthority to award or order financial restitution and requires theredaction of all personal identifying information for law-enforcementpersonnel from all public reports made by the law-enforcement civilianoversight body.
