A BILL to amend and reenact §§ 2.2-203.3, 2.2-401.01, 2.2-3705.3, 2.2-3705.6, 2.2-3705.7, 2.2-3711, 2.2-3802, 2.2-4002, 2.2-4346, 3.2-102, 3.2-6201, 4.1-100, 4.1-206.3, as it is currently effective and as it shall become effective, 8.01-216.3, 8.01-534, 11-16.1, 11-16.2, 15.2-912.2, 15.2-2825, 18.2-325, 18.2-326, 18.2-334.2 through 18.2-334.5, 19.2-66, 19.2-215.1, 19.2-389, 19.2-390, 22.1-140.1, 37.2-314.2, 52-53, 52-54, 58.1-3, 58.1-439, 58.1-460, 58.1-3510, 58.1-3732.1, and 59.1-542.1 of the Code of Virginia; to amend the Code of Virginia by adding a title numbered 29.5, containing a subtitle numbered I, containing chapters numbered 1 through 6, consisting of sections numbered 29.5-100 through 29.5-648, and a subtitle numbered II, containing chapters numbered 7 and 8, consisting of sections numbered 29.5-700 through 29.5-814; and to repeal §§ 2.2-2455 and 2.2-2456, Article 1.1:1 (§§ 18.2-340.15 through 18.2-340.37) of Chapter 8 of Title 18.2, Chapter 40 (§§ 58.1-4000 through 58.1-4048) of Title 58.1, Chapter 41 (§§ 58.1-4100 through 58.1-4141) of Title 58.1, Chapter 29 (§§ 59.1-364 through 59.1-405) of Title 59.1, and Chapter 51 (§§ 59.1-556 through 59.1-570) of Title 59.1 of the Code of Virginia, relating to Virginia Gaming Commission; established; penalties.

Unauthorized use of voice or likeness; punitive damages; statute of limitations. Expands the existing ability for any person to maintain a suit in equity, including the accompanying remedies available and statute of limitations, for the unauthorized use of his name, portrait, or picture for advertising purposes or for the purposes of trade to include the unauthorized use of his voice or likeness.
Department of Veterans Services; provision of copies of veteran vital records. Requires the Board of Health to provide a copy of a veteran's vital records to the Department of Veterans Services upon the Department's request when a veteran or his surviving spouse requires a certified copy of a vital record to obtain service-connected benefits. This bill was incorporated into HB 2748.
Horse racing and pari-mutuel wagering; breakage. Amends the definition of "breakage" for the purposes of horse racing other than historical horse racing to mean the odd cents by which the amount payable on each dollar wagered exceeds one cent ($0.01). The bill also provides that 100 percent of the legitimate breakage from each pari-mutuel pool for historical horse racing shall be distributed to the Problem Gambling Treatment and Support Fund.
K-12 schools and institutions of higher education; student participation in women's sports; civil cause of action. Requires each interscholastic, intercollegiate, intramural, or club athletic team or sport sponsored by a public school, or any other school that is a member of the Virginia High School League, or by a public institution of higher education to be expressly designated as one of the following based on the biological sex of the students who participate on the team or in the sport: (i) males, men, or boys; (ii) females, women, or girls; or (iii) coed or mixed if participation on such team or sport is open to both males and females. The bill requires that the biological sex of any student seeking to participate on such an expressly designated team be affirmed by a signed physician's statement. The bill prohibits any such team or sport that is expressly designated for females from being open to students whose biological sex is male. The bill prohibits any government entity, licensing or accrediting organization, or athletic association or organization from entertaining a complaint, opening an investigation, or taking any other adverse action against any such school or institution of higher education based on a violation of the provisions of the bill and creates a cause of action for any school or institution of higher education that suffers harm as a result of a violation of the bill. Finally, the bill creates a civil cause of action for any student who suffers harm as a result of a knowing violation of a provision of the bill by a school or institution or as a result of the student's reporting a violation of a provision of the bill by a school, institution, athletic association, or organization.
Casino gaming; set-off of debts to the Commonwealth from prizes. Directs the Virginia Lottery Board to adopt regulations to establish and implement a set-off debt collection program in accordance with the provisions of the Setoff Debt Collection Act, wherein certain casino gaming prizes shall be subjected to delinquent debts of agencies and institutions of the Commonwealth.
Fantasy Contests Act; minimum age requirement. Increases from 18 years of age to 21 years of age the minimum age required to participate in fantasy contests.
Virginia Disposition of Unclaimed Property Act; administrator to exercise due diligence to locate owner. Requires the State Treasurer or his designee to exercise due diligence to locate the owner of unclaimed funds or abandoned property previously paid or delivered to the State Treasurer or his designee. Such exercise of due diligence shall include, if necessary, that the State Treasurer or his designee coordinate with the Tax Commissioner to provide the Department of the Treasury with relevant tax information for the purposes of locating such owner. This bill was incorporated into SB 996.
State Air Pollution Control Board; regulations; low-emissions and zero-emissions vehicle standards. Repeals the State Air Pollution Control Board's authority to implement low-emissions and zero-emissions vehicle standards that apply to vehicles with a model year of 2025 and later.
