Emergency custody and temporary detention orders; custody. Requires a facility or location to which a minor or adult who is subject to an emergency custody or temporary detention order is transported to accept custody of the minor or adult upon completion of transportation and arrival of the minor or adult at the facility and specifies that the primary law-enforcement agency shall provide transportation of a person who is involved in the involuntary commitment process, rather than a sheriff, as provided under current law.

Revocation of driver's licenses; completionof specialty dockets. Provides that a conviction that resultedfrom a final order being entered by a court after the successfulcompletion of a Veterans Treatment Court Program, behavioral healthdocket, or other specialty docket shall not be counted as a convictionfor the purposes of revoking a person's driver's license for multipleconvictions of driving while intoxicated.

Constitutional amendment (first reference);real property tax; exemption for certain surviving spouses of membersof the armed forces. Authorizes the General Assembly to exemptfrom tax the real property of a surviving spouse of a member of thearmed forces who died in the line of duty while performing officialmilitary activities. The amendment provides that such exemption isonly available when the death of such member of the armed forces did not result from criminal conduct. The current Constitution exemptsthe real property of a surviving spouse of a member of the armedforces who was killed in action, a disabled veteran, and the survivingspouse of a disabled veteran.

Emergency custody and temporary detention; transportation and custody. Amends numerous sections governing emergency custodyand temporary detention of minors and adults to clarify duties oflaw-enforcement agencies and mental health facilities with regardto custody. The bill requires facilities to take custody of a minoror person who is the subject of an emergency custody order or temporarydetention order immediately upon completion of transportation andarrival of the minor or person at the facility; specifies that ifa facility does not take custody of a minor or person immediatelyupon completion of transportation and arrival at the facility, theorder is void and the minor or person shall be released; providesthat emergency custody orders shall not be extended; and makes otherchanges to clarify the role and obligations of law enforcement inthe emergency custody and temporary detention process.

Distribution of recordation tax to cities andcounties. Reestablishes the distribution of $20 million of state recordation tax revenue to counties and cities to be used for transportationor public education purposes. Legislation in 2020 dedicated the $20million to the Hampton Roads Regional Transit Program.

School principals; incident reports. Requiresthat school principals report to law enforcement certain enumerated acts that may constitute a misdemeanor offense and report to theparents of any minor student who is the specific object of such actthat the incident has been reported to law enforcement. Under currentlaw, principals are required to make such reports only for such actsthat may constitute a felony offense.

Emergency custody and temporary detention; transportation;transfer of custody. Provides that, in cases in which transportationof a person subject to an emergency custody order or temporary detentionorder is ordered to be provided by an alternative transportation provider,the primary law-enforcement agency that executes the order may transfercustody of the person to the alternative transportation provider immediatelyupon execution of the order, and that the alternative transportationprovider shall maintain custody of the person from the time custodyis transferred to the alternative transportation provider by the primarylaw-enforcement agency until such time as custody of the person istransferred to the community services board or its designee that isresponsible for conducting the evaluation or the temporary detentionfacility, as is appropriate. The bill also adds employees of and personsproviding services pursuant to a contract with the Department of BehavioralHealth and Developmental Services to the list of individuals who mayserve as alternative transportation providers.

Workplace violence protective orders. Providesthat an employer may petition the court for a preliminary protectiveorder or a protective order to protect the health and safety of itsemployees. The bill provides that the venue for a workplace violenceprotective order is the jurisdiction where the workplace is locatedfrom which the petitioner seeks to have the respondent prohibited.
