Consumer Data Protection Act; controller privacynotice; cookies; consumer consent. Requires the privacy noticethat a controller must provide to consumers to include a method bywhich a consumer may opt out of the automatic placement of a datafile, commonly referred to as a "cookie," on the consumer's computeror web browser and a disclosure of the purposes for which the datafiles are used. The bill prohibits controllers from using cookies,except those that are strictly necessary, without the prior expressconsent of the consumer and prohibits controllers from preventingaccess to their services if such consent is not granted. The billalso requires controllers to document and store proof of such consent and make available an easily accessible method by which consumersmay withdraw such consent.

Carrying a firearm or explosive material withinCapitol Square and the surrounding area, into a building owned orleased by the Commonwealth, etc.; exceptions for law-enforcementofficers. Adds an exception for off-duty law-enforcement officersto the prohibition of carrying a firearm within any building ownedor leased by the Commonwealth or any agency thereof or any officewhere employees of the Commonwealth or any agency thereof are regularlypresent for the purpose of performing their official duties.

Kinship as Foster Care Prevention Program established. Establishes the Kinship as Foster Care Prevention Program to promote and support placements of children with relatives by local boards of social services in order to avoid foster care. The bill provides that a child is eligible to participate in the Program if the local board determines that (i) the child is at imminent risk of being removed from his home and a preliminary protective order is insufficient to address the child's immediate safety concerns and (ii) the child's parent or guardian consents to the placement of the child with a relative pursuant to an agreement with the local board developed in accordance with the provisions of the bill. This bill is incorporated into SB 39.

Celebrating the life of Emmitt Bruce Marshall.

Felony homicide; certain drug offenses; penalty. Provides that a person is guilty of felony homicide, which constitutessecond degree murder and is punishable by confinement of not lessthan five nor more than 40 years, if the underlying felonious actthat resulted in the killing of another involved the manufacture,sale, gift, or distribution of a Schedule I or II controlled substanceto another and (i) such other person's death results from his useof the controlled substance and (ii) the controlled substance is the proximate cause of his death. The bill provides that venue fora prosecution of this crime shall lie in the locality where the underlyingfelony occurred, where the use of the controlled substance occurred,or where death occurred. The bill also provides that if a persongave or distributed a Schedule I or II controlled substance onlyas an accommodation to another individual who is not an inmate ina community correctional facility, local correctional facility, orstate correctional facility, or in the custody of an employee thereof,and not with intent to profit thereby from any consideration receivedor expected nor to induce the recipient of the controlled substanceto use or become addicted to or dependent upon such controlled substance,he is guilty of a Class 5 felony.

Annual retail sales and use tax holiday.Establishes an annual retail sales and use tax holiday that takesplace on the first full weekend in August beginning on August 1,2025. During such weekend, state retail sales and use tax will notapply to certain (i) school supplies, (ii) clothing and footwear,(iii) qualified products designated as Energy Star or WaterSense,(iv) portable generators, or (v) hurricane preparedness equipment.
