Right to work; repeals provisions of Code that refers to denial or abridgement.

Right to work. Repeals the provisions ofthe Code of Virginia that, among other things, prohibit any agreementor combination between an employer and a labor union or labor organizationwhereby (i) nonmembers of the union or organization are denied theright to work for the employer, (ii) membership in the union or organizationis made a condition of employment or continuation of employment bysuch employer, or (iii) the union or organization acquires an employmentmonopoly in any such enterprise.

Small Business Procurement Enhancement Program; established, report.

Department of Small Business and Supplier Diversity;Small Business Procurement Enhancement Program established; report.Establishes the Small Business Procurement Enhancement Program (theProgram) with a statewide goal of 42 percent of small business utilizationin all discretionary spending by state agencies in procurement orders,prime contracts, and subcontracts. In addition, the bill (i) providesfor a small business set-aside for competition among all small businessesfor state agency purchases of up to $100,000 for goods, nonprofessionalservices, and construction and up to $80,000 for professional servicesand (ii) establishes certification criteria for participation inthe Program by business operations on the basis of the total numberof employees or annual gross receipts, averaged over the previousthree years.

Constitutional amendment; legislative compensation, Legislative Compensation Commission established.

Constitutional amendment (first reference);legislative compensation; Legislative Compensation Commission.Establishes the Legislative Compensation Commission, charged withdetermining the salaries, allowances, and retirement benefits ofthe members of the General Assembly. Members would receive no compensationfrom the Commonwealth other than the compensation determined by theCommission. The Commission is established by appointment of the GeneralAssembly every four years beginning July 1, 2026.

Constitutional amendment; removes same-sex marriage prohibition.

Constitutional amendment (first reference);marriage; repeal of same-sex marriage prohibition; recognition ofsame-sex marriages. Repeals the constitutional provision definingmarriage as only a union between one man and one woman, as well asthe related provisions that are no longer valid as a result of theUnited States Supreme Court decision in Obergefell v. Hodges,576 U.S. 644 (2015). The amendment provides that the Commonwealthand its political subdivisions and its agents are required to issuemarriage licenses, recognize marriages, and treat all marriages equallyunder the law, regardless of the gender of the two parties to themarriage. The amendment further provides that religious organizationsand clergy acting in their religious capacity have the right to refuseto perform any marriage.

Virginia Equal Pay Act; civil penalties.

Virginia Equal Pay Act; civil penalties. Prohibits public and private employers from discriminating between employees on the basis of membership in a protected class in the payment of wages or other compensation, including benefits, by paying wages or other compensation to employees who are members of a protected class at a rate less than the rate at which it pays wages or other compensation to employees who are not members of the protected class for substantially similar work. The measure also prohibits an employer from discriminating between employees by providing less favorable employment opportunities on the basis of membership in a protected class, limiting an employee's right to discuss wages, relying on the wage history of a prospective employee in considering the prospective employee for employment or determining the wages that the prospective employee is to be paid by the employer upon hire, or taking certain retaliatory actions against an employee. The measure also establishes criteria for when wage differentials between employees are permitted, but requires an employer to (i) provide a prospective employee with the wage range for the position for which the prospective employee is applying upon request or prior to inquiring about the prospective employee's wage expectations or providing an offer of compensation and (ii) maintain records of the wages and wage rates, job classifications, and other terms and conditions of employment for a period of three years. The measure gives an employee who is the subject of a violation a right of action to recover, for certain violations, the greater of compensatory damages or $10,000, liquidated damages, punitive damages, and attorney fees. Violations are also subject to civil penalties.
