Voting Rights for Women Month. DesignatesNovember, in 2021 and in each succeeding year, as Voting Rights forWomen Month in Virginia.
Auxiliary grants; assisted living facilities.Directs the Commissioner for Aging and Rehabilitative Servicesto adopt regulations that allow an assisted living facility in which30 percent or more of the residents are auxiliary grant recipientsto receive 200 percent of the auxiliary grant rate.
Local school boards; open enrollment policyrequired. Requires all local school boards to establish and implementpolicies to provide for the open enrollment to any school of anystudent who is eligible to receive free or reduced lunch upon therequest of a parent or guardian, subject to conditions and limitationsestablished by the local school board.
Worker classification; independent contractors. Provides that in a proceeding involving allegations of worker misclassification an individual or business is not considered an employee with respectto a hiring party if the person qualifies as an independent contractorrelative to the hiring party under the common law right-of controltest as established by the Internal Revenue Service Revenue Ruling87-41, by an applicable determination of the Internal Revenue Service,or if (i) the individual or business signs a written contract withthe hiring party stating that the individual or business is self-employedor is being engaged as an independent contractor and containing certainacknowledgments, (ii) the individual or business has the right tocontrol the manner and means by which the final result of the workis to be accomplished, and (iii) four or more additional criteriaprovided for in the bill are satisfied. The bill also provides thata hiring party alleging that a worker misclassification claim is frivolous or improper may file a motion to dismiss such claim. Thebill provides that a contract or written agreement expressly statingthat a claimant is not considered an employee is considered as primafacie evidence of a violation of frivolous pleading provisions.
Emergency Services and Disaster Law; limitationon duration of executive orders. Limits the duration of any executiveorder issued by the Governor pursuant to his powers under the EmergencyServices and Disaster Law to no more than 45 days from the date ofissuance. The bill provides that if the General Assembly does nottake any action on the rule, regulation, or order within the 45 daysduring which the rule, regulation, or order is effective, the Governorshall thereafter be prohibited from issuing the same or a similarrule, regulation, or order relating to the same emergency. Under current law, once issued, such executive orders are effective untilJune 30 following the next regular session of the General Assembly.
