Prohibited acquisition of residential land;restrictions; civil penalty. Restricts any partnership, corporation,or real estate investment trust that manages funds pooled from investors,is a fiduciary to such investors, and has $50 million or more innet value or assets under management on any day during a taxableyear from acquiring any interest in residential land, as definedin the bill, in the Commonwealth and requires registration with the Secretary of the Commonwealth on or after July 1, 2024. The billrequires the Secretary to report annually by December 1 on the registrationsand any penalties assessed for failure to register and to submit such report to the Governor and the General Assembly. The bill alsorequires all real property tax bills to contain notice of such prohibitedbusiness ownership restrictions and registration requirements.

Motor vehicle sales and use tax; exemptions;transfers; limited liability companies. Provides that no motorvehicle sales and use tax shall be imposed on vehicle transfers from(i) an individual, partnership, or limited liability company to acorporation or limited liability company or (ii) from a corporation or limited liability company to an individual, partnership, or limited liability company if (a) the transfer is incidental to the formation,organization, or dissolution of a corporation or limited liabilitycompany in which the individual, partnership, or limited liabilitycompany holds the majority interest in both entities and (b) the transferto a limited liability company is not a precursor to a transfer ofcontrol of the assets of the company to avoid motor vehicle salesand use taxes. Under current law,transfers from (1) an individual or partnership to a corporationor limited liability company or (2) from a corporation or limitedliability company to an individual or partnership are exempt fromthe motor vehicle sales and use tax if the transfer is incidentalto the formation, organization, or dissolution of a corporation orlimited liability company in which the individual or partnershipholds the majority interest.
Department of Education; model policy on studentcell phone use during instructional time; local adoption. Requiresthe Department of Education to develop, adopt, and distribute to each school board a model policy whereby public elementary and secondaryschool students are prohibited from possessing or using personalcell phones or other personal handheld communication devices duringinstructional time at school. The bill requires the Department, indeveloping and adopting such model policy, to seek to balance theinterests of students' academic achievement, cognitive development,safety, and general well-being and permits the Department to include appropriate exceptions in extraordinary circumstances such as emergency situations or situations involving the need to contact the student'sparents. The bill requires each school board to develop and adopta policy that is consistent with such model policy adopted by theDepartment.
Local review of zoning decisions. Clarifiesthat a locality may schedule regular reviews of previous zoning decisionsin order to determine whether provisions of the zoning ordinance(i) continue to meet the general purpose of promoting the health,safety, or general welfare of the public and (ii) are compatiblewith changes in land use patterns.
Health insurance; denial of referral by directprimary care provider prohibited. Prohibits a health insurancecarrier from (i) denying payment for any health care service coveredunder an enrollee's health benefit plan based solely on the basisthat such enrollee's referral was made by a direct primary care provideror (ii) imposing a cost-sharing requirement greater than the applicablecost-sharing requirement that would apply to the same health careservice if the service was referred by a participating provider.The bill provides that a health insurance carrier may require a directprimary care provider to provide information demonstrating that suchprovider has entered into a direct primary care agreement with theenrollee.

Institutions of higher education; tuition grants;Virginia National Guard State Tuition Assistance Program. Makesseveral changes to the Virginia National Guard State Tuition AssistanceProgram, including (i) making the provisions relating to the requirements and conditions for eligibility for and award of grants under theProgram subject to regulations as prescribed by the Adjutant General,(ii) eliminating the requirement to satisfy financial obligationswith the institution of higher education at the beginning of each semester, (iii) simplifying the requirements relating to academicperformance and good standing, and (iv) providing that any grantawarded shall be in an amount equivalent to the difference betweenthe full cost of tuition and fees at the institution of higher educationless any other educational benefits for which an individual is eligibleas a member of the National Guard.
