Clinical nurse specialist; practice agreements.

Clinical nurse specialist; practice agreements.Provides that a nurse practitioner licensed by the Boards of Medicineand Nursing in the category of clinical nurse specialist who doesnot prescribe controlled substances or devices may practice in thepractice category in which he is certified and licensed without awritten or electronic practice agreement, provided that he (i) onlypractice within the scope of his clinical and professional trainingand limits of his knowledge and experience and consistent with theapplicable standards of care, (ii) consult and collaborate with otherhealth care providers based on the clinical condition of the patientto whom health care is provided, and (iii) establish a plan for referralof complex medical cases and emergencies to physicians or other appropriatehealth care providers. The bill also provides that a nurse practitionerlicensed by the Boards in the category of clinical nurse specialistwho prescribes controlled substances or devices shall practice inconsultation with a licensed physician in accordance with a practiceagreement between the nurse practitioner and the licensed physician.

Registered surgical technologist; criteria for registration.

Certified surgical technologist; criteria for certification. Requires the Board of Medicine to certify as a surgical technologist any applicant who has practiced as a surgical technologist or attended a surgical technologist training program at any time prior to October 1, 2022, and registers with the Board by December 31, 2022. Under current law, an applicant who practiced as a surgical technologist at any time in the six months prior to July 1, 2021, and registered by December 31, 2021, is eligible for certification by the Board. The bill also provides that no person shall use the designation "C.S.T." or any variation thereof unless such person (i) is certified by the Board and (ii) has successfully completed an accredited surgical technologist training program and holds a current credential as a certified surgical technologist from the National Board of Surgical Technology and Surgical Assisting or its successor.

Health care providers; transfer of patient recordsin conjunction with closure, sale, or relocation of practice; electronicnotice permitted. Allows health care providers to notify patientseither electronically or by mail prior to the transfer of patientrecords in conjunction with the closure, sale, or relocation of thehealth care provider's practice. Current law requires health careproviders to provide such notice by mail.

Unlawful hazing; amends definition, civil and criminal liability, penalties.

Unlawful hazing; penalty. Amends the definitionof hazing to include the reckless or intentional act of causing anotherperson to suffer severe emotional distress through outrageous orintolerable conduct when the severe emotional distress was causedby the outrageous or intolerable conduct. The bill also makes thecrime of hazing a Class 5 felony if such hazing results in deathor serious bodily injury to any person. The crime of hazing that doesnot result in death or serious bodily injury remains a Class 1 misdemeanor.The bill provides immunity for arrest and prosecution for hazingif a person in good faith seeks or obtains emergency medical attentionfor a person who has received a bodily injury by hazing or rendersemergency care or assistance, including cardiopulmonary resuscitation(CPR), to a person who has received a bodily injury by hazing whileanother person seeks or obtains emergency medical attention for suchperson. The bill also creates a civil penalty for certain organizationsif such organization had specific credible knowledge that its studentmembers were participating, aiding, or assisting in any act of hazingand did not attempt to intervene to stop the hazing or report itto the appropriate local authorities.
