Multi-jurisdiction grand jury; elder abuse crimes. Adds the following to the list of crimes that a multi-jurisdiction grand jury may investigate: (i) financial exploitation of mentally incapacitated persons and (ii) abuse and neglect of incapacitated adults.
Absentee voting; permanent absentee voter listrepealed. Repeals the provisions of law by which any registered voter may apply to receive absentee ballots for all elections inwhich he is eligible to vote and remains on the list until the voterrequests in writing to be removed from the list, the voter's registrationis canceled or placed on inactive status pursuant to law, or thevoter moves to a different address not in the same county or cityof his registration.
Provision of credit monitoring services to certain taxpayers; emergency. Directs the Department of Taxation to offer,free of charge, credit monitoring services for a period of 12 monthsto any taxpayer whose personal identifying information was erroneouslyprovided to a person other than the taxpayer on an IRS 1099-G form.The bill contains an emergency clause, and will expire on July 1,2023.
United States Constitution; application fora convention of the states. Makes application to Congress tocall a convention of the states to propose amendments to the UnitedStates Constitution that impose fiscal restraints on the federalgovernment, limit the power and jurisdiction of the federal government,and limit the terms of office for its officials and for members of Congress.
Elections; absentee voting; ballots to be sortedand results to be reported by precinct. Provides that absentee ballots processed at a central absentee precinct must be sorted bythe precinct to which the voter who cast the absentee ballot is assignedand that the resulting vote totals from such ballots must be reportedseparately for each voter precinct.
Sales tax; exemption for food purchased forhuman consumption and essential personal hygiene products. Exemptsfood purchased for human consumption and essential personal hygieneproducts (the grocery tax) from all state, regional, and local salestaxes.
Virginia Public Procurement Act; required contract provisions; prohibition on participation in boycott of Israel.Requires all public bodies to include in every contract of more than$10,000 certain provisions, outlined in the bill, related to participation in a boycott of Israel, its instrumentalities, or any of its territorieswhile engaged in commercial activities pursuant to the terms of thecontract. The bill also provides that such contractors shall includethose same provisions in every subcontract or purchase order of morethan $10,000, so that the provisions will be binding upon each subcontractoror vendor.
Constitutional amendment (second reference); qualifications of voters and the right to vote; persons not entitled to vote. Provides that every person who meets the qualifications of voters set forth in the Constitution shall have the fundamental right to vote in the Commonwealth and that such right shall not be abridged by law, except for persons who have been convicted of a felony and persons who have been adjudicated to lack the capacity to understand the act of voting. A person who has been convicted of a felony shall not be entitled to vote during any period of incarceration for such felony conviction but upon release from incarceration for that felony conviction and without further action required of him, such person shall be invested with all political rights, including the right to vote. Currently, in order to be qualified to vote a person convicted of a felony must have his civil rights restored by the Governor or other appropriate authority. The amendment also provides that a person adjudicated by a court of competent jurisdiction as lacking the capacity to understand the act of voting shall not be entitled to vote during this period of incapacity until his capacity has been reestablished as prescribed by law. Currently, the Constitution provides that a person who has been adjudicated to be mentally incompetent is not qualified to vote until his competency is reestablished.
Criminal cases; sentencing by jury. Providesthat if a jury finds a person guilty of a criminal offense, suchjury shall ascertain the punishment of the offense. Under currentlaw, unless the accused has requested that the jury ascertain punishment,the court shall fix punishment after the accused has been found guiltyby a jury.
Study; Department of Education; purpose and goals of public education; report. Requests that the Department of Education study the purpose and goals of public education by encouraging input from the citizens of the Commonwealth, including parents, teachers, school administrators, and local school board members, to clarify (i) the broader purpose of public education in light of the fundamental goal of public education, as expressed by the General Assembly and the Board of Education, and (ii) the specific measurable outcomes that education laws, regulations, policies, and practices should help to achieve in order to further such broader purpose and such fundamental goal.
