Constitutional amendment (first reference);marriage; repeal of same-sex marriage prohibition; recognition ofsame-sex marriages. Repeals the constitutional provision definingmarriage as only a union between one man and one woman, as well asthe related provisions that are no longer valid as a result of theUnited States Supreme Court decision in Obergefell v. Hodges,576 U.S. 644 (2015). The amendment provides that the Commonwealthand its political subdivisions and its agents are required to issuemarriage licenses, recognize marriages, and treat all marriages equallyunder the law, regardless of the gender of the two parties to themarriage. The amendment further provides that religious organizationsand clergy acting in their religious capacity have the right to refuseto perform any marriage.

Virginia Beach Tourism Authority. Establishesthe Virginia Beach Tourism Authority as a public body corporate andas a political subdivision of the Commonwealth. The Authority, governedby a 13-member board of directors, shall encourage, stimulate, andsupport tourism in the City of Virginia Beach by promoting, marketing,and advertising the City's many tourist attractions and locations.
Unemployment compensation; overpayments dueto administrative error. Provides that if an individual receivesan overpayment of unemployment benefits under the state program thatoccurred due to an administrative error, the individual is not requiredto repay the overpayments.
Income tax; subtraction for low-income military veterans with a permanent service-connected disability. Provides an income tax subtraction for the military retirement income received by a veteran who has been rated with a 100 percent service-connected, permanent, and total disability. The bill provides that the subtraction is available only to those taxpayers whose federal adjusted gross income is not greater than 150 percent of the federal poverty level for a four-person household. This bill incorporates HB 125.
Flood Insurance Fund; low-income Virginians.Creates a Flood Insurance Fund and directs the Executive Director of the Board of Directors of the Virginia Resources Authority toestablish a program to use the Fund to subsidize the purchase offlood insurance by low-income Virginians. Such program shall includean application process, application guidelines, and a ranking systemthat prioritizes the use of the Fund to support the purchase of floodinsurance in the most flood-prone areas.
Constitutional amendment (first resolution);real property tax exemption; affordable housing. Provides thatthe General Assembly may authorize a locality to fully or partiallyexempt affordable housing, as such term may be defined by statute,from real property taxation.
General Assembly meetings; streaming and recording. Requires the Clerk of the House of Delegates and the Clerk of theSenate to ensure that every (i) subcommittee or committee meetingof a standing committee of the General Assembly, regardless of meetingdate, and (ii) floor session of the House of Delegates or the Senate,including any joint session of the houses, is streamed with closedcaptioning, recorded and archived. The bill defines "stream" and specifiesthat a qualifying meeting is one the date and time of which havebeen scheduled on a public website of any agency of the General Assemblyfor at least one hour prior to the meeting and that takes place inthe State Capitol, the Pocahontas Building, or the General AssemblyBuilding in Richmond. The bill has a delayed effective date of October1, 2020.
Wage or salary history inquiries prohibited; civil penalty. Prohibits a prospective employer with 25 employees or more from (i) requiring as a condition of employment that a prospective employee provide or disclose the prospective employee's wage or salary history, (ii) attempting to obtain the wage or salary history of a prospective employee from the prospective employee's current or former employers, (iii) requesting a prospective employee to complete an application for employment that includes a question inquiring about the prospective employee's wage or salary history, or (iv) asking a prospective employee in an employment interview any question intended to obtain information about the prospective employee's wage or salary history. Violations are subject to a civil penalty not to exceed $100 per violation. This bill incorporates HB 326 and HB 802.
