Concealed handgun permits; penalties. Changesthe penalty for a first violation of carrying a concealed weapon without a permit from a Class 1 misdemeanor to a civil penalty ofnot more than $100, a second violation from a Class 6 felony to a Class 2 misdemeanor, and a third or subsequent violation from a Class5 felony to a Class 1 misdemeanor. The bill also provides that aperson, unless otherwise disqualified, shall not be precluded fromapplying for a concealed handgun permit during the pendency of theproceedings for a violation. If such person is issued a valid concealedhandgun permit while a charge for a violation is pending, he mayoffer such permit to the court, and the court may dismiss the charge.

Prosecution of felony due to lapse of time; judicial emergency; administrative delays. Provides that the speedy trial provisions shall be tolled upon a declaration of a judicial emergency. The bill also provides that the speedy trial provisions shall be tolled upon administrative delays resulting from the enactment of Chapter 43 of the Acts of Assembly of 2020, Special Session I, and creates a process by which a party may file a motion for an immediate interlocutory appeal of a trial date set outside of the speedy trial provisions if such trial could not be scheduled due to such administrative delays. The provisions of the bill related to such administrative delays sunset on December 31, 2024.
Public school buildings; entry points; limits;screening. Requires each local school board to (i) limit to thelowest feasible number the entry points in each public school buildingin the local school division, (ii) ensure that each individual whoseeks to enter any school building in the local school division isscreened with a handheld metal detector wand by a school securityofficer or another appropriate school board employee who is appropriatelytrained in such method of screening, (iii) require each such schoolsecurity officer or other appropriate school board employee to implement further screening according to a protocol that it deems appropriatein any case in which the school board employee who conducts the initialscreening has reason to believe that the individual who seeks toenter the school building is in possession of a weapon, and (iv)prohibit any individual from entering any school building in thelocal school division if the individual fails or refuses to submitto the screening required in clauses (ii) and (iii).
Purchase of handguns; limitation on handgunpurchases. Removes the prohibition on any person who is not a licensed firearms dealer from purchasing more than one handgun ina 30-day period. Current law makes it a Class 1 misdemeanor for aviolation of this provision, subject to certain exemptions.
Provision of credit monitoring services to certain taxpayers; emergency. Directs the Department of Taxation to offer,free of charge, credit monitoring services for a period of 12 monthsto any taxpayer whose personal identifying information was erroneouslyprovided to a person other than the taxpayer on an IRS 1099-G form.The bill contains an emergency clause, and will expire on July 1,2023.
Expungement of emergency and preliminary protectiveorders. Provides that a person against whom an emergency or preliminaryprotective order has been issued may petition to have police andcourt records relating to such order expunged if the order expiresor is dissolved by the issuing court or if a hearing for the issuanceof a permanent protective order is scheduled or held and such permanentprotective order is subsequently not issued.
Carrying dangerous weapon to place of religiousworship; repeal. Repeals the prohibition on the carrying of dangerousweapons in a place of worship without good and sufficient reasonwhile a meeting for religious purposes is being held at such place.
Fees for resident concealed handgun permits.Eliminates the fees that may be charged for the processing of anapplication for or issuing of a resident concealed handgun permit, including any costs associated with the clerk's consultation withlaw-enforcement agencies.
