Public-Private Transportation Act of 1995; Public-Private Education Facilities and Infrastructure Act of 2002; affected local jurisdictions and public entities; consideration of economic impact.Requires a private entity requesting approval to develop and operatea qualifying transportation facility under the Public-Private TransportationAct of 1995 or a qualifying project under the Public-Private EducationFacilities and Infrastructure Act of 2002 to include an economicimpact analysis identifying any potentially adverse economic or revenueimpacts a potential comprehensive agreement may have on all affectedlocal jurisdictions. The bill further provides that affected localjurisdictions be given reasonable opportunity to consult with theparties concerning the nature and scope of the impacts and regardingmeasures that may be taken to avoid or mitigate the impacts or make the agreement revenue-neutral. The bill directs each responsiblepublic entity to certify compliance with the review of the economicimpact analysis provisions.

Installation of certain facilities by developer; reimbursement. Provides specific parameters to address the installationof reasonable and necessary sewerage and water facilities locatedon or outside the property limits of the land owned or controlledby the developer or subdivider that is necessitated or required,at least in part, by the utility needs of the development or subdivision,including reasonably anticipated capacity, extensions, or maintenanceconsiderations of a utility service plan for the service area. Suchdeveloper or subdivider shall be entitled to reimbursement of itscosts, including a new mechanism for connection fee reimbursement,by any subsequent developer or subdivider that utilizes the installedsewerage or water facility, except for those costs associated withthe installing developer's pro rata share. The bill provides authority,at the developer's option, for reimbursement for the water and sewerfacility in exchange for entitlement to water or sewer connectionor capacity fees otherwise due to the locality imposed upon the developer'slots within its development or subdivision.
Petition for vacatur and expungement of convictionsand police and court records of victims of human trafficking.Allows any person who was a victim of human trafficking at the timeof an offense that led to a criminal charge or conviction of certaincrimes to petition the court to vacate such conviction and expungethe police and court records related to such conviction or to expungethe police and court records related to such charge. The bill provides that there is a rebuttable presumption that a person's participationin an offense was a result of having been a victim of human traffickingif there is official documentation, defined in the bill, of the petitioner'sstatus as a victim of human trafficking at the time of the offense.
Transportation agreements. Recognizes that public-private transportation partnership agreements that containprovisions prohibiting or frustrating the construction of non-tolledtransportation facilities as alternatives to tolled facilities througheconomic disincentives are against public policy.
Expungement of police and court records.Provides that a court that enters a nolle prosequi for a criminalcharge or dismisses such charge for any reason may, upon motion ofthe person charged, enter an order requiring the expungement of thepolice and court records relating to the charge.
Right to reproductive choice. Provides thatevery individual has a fundamental right to choose or refuse contraceptionand that a pregnant person has a fundamental right to choose to carrya pregnancy to term, give birth to a child, or terminate a pregnancy.The bill states that the Commonwealth shall not, in the regulationor provision of benefits, facilities, services, or information, denyor interfere with an individual's fundamental rights, including individualsunder state control or supervision. The bill states that any stateor local official who is charged with violating provisions of thissection shall be subject to an action in federal or state court forinjunctive relief and damages. Such action may be brought by any person or entity that may be aggrieved by such official's actions.
Local treasurers; power to summon taxpayersand other persons. Provides that a local treasurer's power tosummon a taxpayer or other person to answer questions under oathor produce documents for the purpose of collecting delinquent amountsowed to the locality applies to any amounts, charges, or fees owedto the locality as well as to taxes owed to the locality. The billcontains a technical amendment.
Eligibility for food stamps; drug-related felonies. Provides that a person who is otherwise eligible to receive food stamp benefits shall not be denied such assistance solely because he has been convicted of a drug-related felony. Under current law, a person otherwise eligible to receive food stamp benefits shall not be denied food stamp benefits based on a felony conviction of possession of a controlled substance in violation of § 18.2-250, provided that such person is complying with, or has already complied with, all obligations imposed by the criminal court, is actively engaged in or has completed a substance abuse treatment program, participates in periodic drug screenings, and fulfills any other obligations as determined by the Department of Social Services. Constitution of the United States; Equal RightsAmendment. Ratifies the Equal Rights Amendment to the Constitutionof the United States that was proposed by Congress in 1972. The jointresolution advocates the position that the 1972 Equal Rights Amendmentremains viable and may be ratified notwithstanding the expirationof the 10-year ratification period set out in the resolving clause,as amended, in the proposal adopted by Congress.
