Equity in public school funding and staffing; special education students; at-risk students; annual report. Establishes in Standard of Quality 2 the At-Risk Program and a state-supported add-on for special education students and requires corresponding formulas for the funding of such initiatives to be established in the general appropriation act. The bill also requires the Department of Education to report annually to the House Committees on Education and Appropriations and the Senate Committees on Finance and Appropriations and on Education and Health the total and per pupil annual operating expenditures from local, state, and federal sources in each school division and the change in expenditures from each such source over the immediately preceding two-year, three-year, and five-year timeframes, expressed in both dollar amounts and percentages.

Retail sales and use tax; exemption for data centers. Requires a data center operator, in order to be eligible for the existing data center sales and use tax exemption, to (i) beginning July 1, 2027, not use co-located generating facilities that emit carbon dioxide, other than backup generators; (ii) beginning July 1, 2029, contract for a certain percentage of energy, capacity, and renewable energy certificates from clean energy resources, as evidenced by a certification from the State Corporation Commission, or contracts and service agreements; (iii) utilize only non-carbon dioxide-emitting backup power sources, such as energy storage resources, beginning on a date dependent on the data center's initial service date; and (iv) demonstrate, for any new data center issued a final certificate of occupancy or its equivalent on or after January 1, 2030, or for any data center operator seeking an amended memorandum of understanding, sufficient investment in environmental management and energy efficiency measures to provide system-wide benefits, as defined in the bill. Finally, the bill has a delayed effective date of July 1, 2027.
State Corporation Commission; Phase I Utility; 2026 biennial rate review; report. Directs the State Corporation Commission to consider certain requirements in the 2026 review of the rates, terms, and conditions for the provision of generation and distribution services by Appalachian Power. The bill directs the Commission to review the decision by Appalachian Power to satisfy its capacity obligations with the regional transmission entity through a fixed resource requirement alternative. The bill also directs the Commission to conduct a review of Appalachian Power's efforts to improve system efficiency, resilience, and reliability to address rising costs of responding to severe weather events. The bill requires the Commission to submit a report summarizing its review and providing recommendations by September 1, 2027, or to include such report as part of an existing annual report.
Public institutions of higher education; financial assistance; Medical Education Loan-for-Service Fund and Program established; report. Establishes the Medical Education Loan-for-Service Fund and Program (the Program) for the purpose of providing loans to any person enrolled in or admitted to an eligible institution, as defined in the bill, that shall be forgiven in whole or in part upon satisfactory completion of a service agreement entered into by a recipient to engage in clinical practice in a designated service area, as defined in the bill, for the requisite period and in accordance with the requirements set forth by the bill. The bill directs the State Council of Higher Education for Virginia (the Council) and the Virginia Health Workforce Development Authority (the Authority) to administer the Program and to enter into a memorandum of understanding establishing policies and procedures for the administration of the Program. The bill also (i) establishes requirements for the administration of the Program, including (a) requirements for eligibility to apply to and receive a loan under the Program and the prioritization of Program applications and (b) terms and conditions governing the receipt, forgiveness, and repayment of loans under the Program; (ii) directs the Council and the Authority to promulgate regulations for the administration of the Program relating to monitoring and enforcing compliance of recipients with Program requirements and terms and conditions; (iii) authorizes the Council to take certain actions relating to the enforcement of Program requirements and the collection of loans in certain circumstances; and (iv) directs the program administrator to annually collect data on the activities of the Program for the preceding fiscal year and submit to the Governor and the Chairs of the House Committees on Education, Health and Human Services, and Appropriations and the Senate Committees on Education and Health and Finance and Appropriations a report on such data by October 1 of each year. Finally, the bill directs the Council to promulgate such regulations as are necessary for (a) the program administrator to begin collecting applications for the Program by January 1, 2027, and (b) the disbursement of loans under the Program no later than July 1, 2027.
Photo speed monitoring devices; reduced-speed segments. Authorizes a locality without its own law-enforcement agency to, by ordinance, place and operate a photo speed monitoring device at a reduced-speed segment, defined in the bill, located within the locality for the purpose of recording violations resulting from the operation of a vehicle in excess of the speed limit. The bill requires any such locality to, by ordinance, authorize officers of the law-enforcement agency with jurisdiction within such locality or retired sworn law-enforcement officers employed by the locality to issue the summons and to swear to or affirm the certificate stating that the information produced by such photo speed monitoring device shows evidence of a vehicle speed violation. The bill provides the same requirements for such devices, information collected from such devices, and any enforcement actions resulting from information collected from such devices as current law applies to the use of such devices in school crossing zones, highway work zones, and high-risk intersection segments.

Permits a state or local law-enforcement agency to place and operate a photo speed monitoring device at a historic district segment, defined in the bill, located within the locality for the purpose of recording violations resulting from the operation of a vehicle in excess of the speed limit. The bill provides the same requirements for such devices, information collected from such devices, and any enforcement actions resulting from information collected from such devices as current law applies to the use of such devices in school crossing zones, highway work zones, and high-risk intersection segments.
Land preservation tax credit; maximum amount increase. Increases from $75 million to $100 million, beginning in calendar year 2026, the maximum amount of land preservation tax credits that may be issued in a calendar year.
Virginia Student Environmental Literacy Plan Grant Fund and Program established. Establishes the Virginia Student Environmental Literacy Plan Grant Fund and Program, to be administered by The Office of Environmental Education, in consultation with the Department of Education and any other stakeholder that it deems appropriate, for the purpose of awarding grants on a competitive basis to any school division that seeks assistance to develop a local student environmental literacy plan.
Zoning for Housing Production Pilot Program created; affordable dwelling unit policy incentives; report. Creates the Zoning for Housing Production Pilot Program to be administered by the Department of Housing and Community Development. To be eligible for a grant from the Program, an eligible locality, as named in the bill, is required to make a change to its zoning policies to allow for by-right development that is expected to further the goal of creating and maintaining mixed-income communities, affordable housing, and moderately priced housing, as those terms are defined in the bill. The Department is required to establish certain guidelines for the Program and to notify eligible localities of the existence and purpose of the Program no later than February 1, 2027. The bill has an expiration date of July 1, 2029.
Department of Medical Assistance Services; 1915(c) Home and Community Based Waivers; program rule amendments; direct support professionals. Directs the Department of Medical Assistance Services to seek the necessary approvals to amend the program rules for the Community Living and Family and Individual Supports Waivers to provide for compensation of a direct support professional for a waiver recipient in an acute care hospital under certain circumstances.
