Inspection of certified nursing facilities; compliance with federal reporting requirements.

Inspection of certified nursing facilities; compliance with federal reporting requirements; civil penalty. Directs the Department of Health to include validation of compliance with federal reporting requirements in its inspection process for certified nursing facilities. The bill requires certified nursing facilities to submit a quarterly report detailing (i) all self-reported incidents and compliance issues submitted to the Centers for Medicare and Medicaid Services during the preceding quarter; (ii) any corrective actions taken in response to self-reported incidents; and (iii) updates on ongoing investigations related to reported incidents. The Department may impose a penalty on a certified nursing facility that fails to comply with the reporting requirements imposed by the bill, which may include a civil penalty not to exceed $1,000, increased frequency of inspections, and suspension or revocation of the certified nursing facility's license.

Sales and use tax; additional local tax to support schools, referendum.

Additional local sales and use tax to support schools; referendum. Authorizes all localities to impose an additional local sales and use tax at a rate not to exceed one percent with the revenue used only for public school capital projects, as defined in the bill, if such levy is approved in a voter referendum. The bill removes the requirement that such a tax must have an expiration date on either (i) the date of the repayment of any bonds or loans used for such capital projects or (ii) a date chosen by the governing body. Under current law, only Charlotte, Gloucester, Halifax, Henry, Mecklenburg, Northampton, Patrick, and Pittsylvania Counties and the City of Danville are authorized to impose such a tax.

Chesapeake Bay Preservation Act; certain boundary line adjustments.

Certain boundary line adjustments; Chesapeake Bay Preservation Act. Requires a locality to provide, by ordinance, that a boundary line adjustment that applies to lots that are located in a Resource Protection Area and that are grandfathered under the Chesapeake Bay Preservation Act does not create a new lot of record. The bill requires such ordinance to include that such boundary line adjustment shall be considered as a lot that predates the Act. The bill clarifies that its provisions do not limit a locality's zoning authority. The bill also directs the State Water Control Board to amend its criteria under the Act to allow an owner of a lot in any locality that predates the Act to submit an application for a boundary line adjustment without creating a new lot of record.

Higher educational institutions, livestreaming, etc., boards of visitors meetings.

Baccalaureate public institutions of higher education; livestreaming, recording, and archiving of boards of visitors meetings; closed sessions; guidelines. Requires each baccalaureate public institution of higher education in the Commonwealth to (i) provide for the livestreaming of each meeting of its full board of visitors in a manner that is accessible to the public in real time and (ii) ensure that recordings of such meetings (a) are made, archived, and made available to the public within five business days following the conclusion of the meeting; (b) remain accessible on the institution's official website for no less than five years from the date of the meeting; and (c) include closed captioning for accessibility and are presented in a format compliant with the federal Americans with Disabilities Act of 1990. The bill requires the board of visitors of each such institution to include a report on the institution's compliance with the foregoing requirements in its statutorily required annual executive summary. The bill also requires the State Council of Higher Education for Virginia to develop and provide to each baccalaureate public institution of higher education guidelines to assist such institutions with complying with the foregoing requirements, including recommendations for technology standards and accessibility features. The bill has a delayed effective date of July 1, 2027.

Motor vehicles insurance; hwy. use fee, tangible personal property tax relief for certain vehicles.

Motor vehicles; insurance; highway use fee; tangible personal property tax relief for certain vehicles. Removes the highway use fee for fuel-efficient vehicles, and maintains the same highway use fee for electric vehicles and alternative fuel vehicles. The bill removes the prohibition on motor vehicle insurers establishing a repair facility network. Under current law, insurers are prohibited from requiring an insured or claimant to utilize designated replacement or repair facilities or services as a prerequisite to settling or paying any claim arising under a policy or policies of insurance. The bill also directs each county, city, or town that receives annual reimbursements from the Commonwealth for providing tangible personal property tax relief on qualifying vehicles to, beginning in tax year 2027, ensure that after first reimbursing certain tax attributable to qualifying vehicles leased by active duty members of the United States military, as is currently required by law, (i) no qualifying vehicle owned by an individual with an annual household income in excess of $200,000 receives any reimbursement for such vehicle and (ii) the remainder of the reimbursement provided to such locality is distributed based on a sliding scale for household incomes of residents of such locality, adopted by an ordinance of the governing body of such locality, as described in the bill.

State correctional facilities; required education or vocational training; earned sentence credits classification levels. Requires a prisoner in a state correctional facility, as a part of his reentry plan developed and implemented by the Department of Corrections, to complete a high school equivalency test or vocational, technical, or other certification prior to such prisoner's release. The bill also provides that the annual review of a prisoner's classification level for earned sentence credits shall include such prisoner's quantifiable or measurable progress, as available, in any programs, job assignments, and educational curricula in which he is participating, such as test scores achieved or completion of a high school equivalency test or other trade or vocational certification.

Tribal Medicaid Advisory Group; established.

Department of Medical Assistance Services; consultation with federally recognized tribes. Establishes a Tribal Medicaid Advisory Group to work collaboratively on (i) plan amendments, waiver requests, and policies affecting tribal health programs at least 60 days prior to submitting them for public notice and comment and (ii) a tribal health program billing manual. The advisory group is required to meet in person on at least a quarterly basis. The bill also requires the Department of Medical Assistance Services to (a) recognize the eligibility of any tribal health program to participate as a provider in the state plan, (b) consult with any tribal health program participating in the state plan at least 60 days prior to taking any adverse action, including suspension of payments or investigation regarding the participation of any tribal health program in the state plan, and (c) engage in ongoing consultation with federally recognized tribes and tribal health programs to address the needs of the state and tribal governments. This bill is a recommendation of the Commission on Updating Virginia Law to Reflect Federal Recognition of Virginia Tribes.

Eliminates the remaining one percent local sales and use tax that is imposed on food purchased for human consumption and essential personal hygiene products. Under current law, no other sales and use tax is applied to such products. The bill requires an equivalent amount of revenue to be distributed to cities and counties on a monthly basis in compensation for the lost tax revenue. The bill has a delayed effective date of January 1, 2027.
