Right to work. Repeals the provisions ofthe Code of Virginia that, among other things, prohibit any agreementor combination between an employer and a labor union or labor organizationwhereby (i) nonmembers of the union or organization are denied theright to work for the employer, (ii) membership in the union or organizationis made a condition of employment or continuation of employment bysuch employer, or (iii) the union or organization acquires an employmentmonopoly in any such enterprise.

Commonwealth Broadband Chief Advisor; broadbandservice territory maps. Requires the Commonwealth Broadband ChiefAdvisor to develop and maintain a map of private broadband providerservice territories, including accurate average broadband speeds insuch territories. The map shall be updated yearly and be made availableto the public.

Fossil fuel projects moratorium. Establishesa moratorium, effective January 1, 2022, on any approval by anystate agency or political subdivision required for (i) electric generatingfacilities that generate fossil fuel energy through the combustionor use of a fossil fuel resource; (ii) import or export terminalsfor fossil fuel resources; (iii) modification of an import or exportterminal for a fossil fuel resource; (iv) gathering lines or pipelinesfor the transport of any fossil fuel resource that requires the useof public land or eminent domain on private property; (v) modificationof such gathering lines or pipelines; (vi) refineries of a fossilfuel resource; (vii) any facilities that change the physical stateof fossil fuels for the purposes of transporting such fuel; and (vii)exploration for any type of fossil fuel, unless preempted by applicablefederal law. The measure requires the establishment of job trainingprograms and energy worker protections, transitional assistance forworkers in the fossil fuel industry and affected communities, andenvironmental justice protections.

Study; joint subcommittee; oversight of Medicaid managed care organizations and provider networks in the Commonwealth; report. Establishes a joint subcommittee to study oversight of Medicaid managed care organizations and provider networks in the Commonwealth, including (i) the current process by which the Department of Medical Assistance Services enters into contracts with managed care organizations for the delivery of services to Medicaid enrollees and the requirements of such contracts; (ii) the process by which managed care organizations enter into and terminate contracts with providers in the Commonwealth, including any procedural requirements that must be met before a provider agreement is terminated and any opportunity for communication and correction by the provider; (iii) managed care organizations' provider networks, including demographic information about enrolled providers and recent changes in managed care organizations' provider networks, including demographic information about providers that have been added to or removed from provider networks in recent years; and (iv) whether changes should be made to contracts between the Department of Medical Assistance Services and managed care organizations to ensure providers are able to meet agreements set forth in provider agreements while ensuring the safety and well-being of Medicaid enrollees, and to develop recommendations for improving the process by which providers of Medicaid services are recruited, enrolled in, participate in, and are terminated from provider networks to ensure access to a diverse array of services and providers for all Medicaid enrollees in the Commonwealth. The joint subcommittee shall complete its meetings by November 30, 2021, and the chairman shall submit to the Division of Legislative Automated Systems an executive summary of its findings and recommendations no later than the first day of the 2022 Regular Session of the General Assembly.

Virginia Clean Economy Act; non-bypassable charges; energy-intensive trade-exposed (EITE) industries. Defines EITEindustries as companies that are constrained in their ability to pass through carbon costs due to international competition, companiesthat engage in importation of products that cause emission leakage,and critical infrastructure facilities identified by certain federalagencies. The bill directs the State Corporation Commission to establishan EITE customer exemption program for non-bypassable charges incertain provisions of the Virginia Clean Economy Act related to generationof electricity from renewable and zero carbon sources and developmentof offshore wind capacity.

Public schools; Standards of Learning assessments;reduction. Reduces the total number and type of required Standardsof Learning assessments to the minimum requirements established bythe federal Elementary and Secondary Education Act of 1965, as amended.

Required release of video or audio recording;discharge of firearm or use of stun weapon or chemical irritant by law-enforcement officer. Requires that, whenever a law-enforcementofficer (i) discharges a firearm or (ii) uses a stun weapon or chemicalirritant on a person resulting in death or serious bodily injury,any video or audio recording that relates to such incident producedor obtained by a law-enforcement officer be open to inspection andavailable for release and posted on a website that is maintained by the law-enforcement agency or on any other website on which the law-enforcement agency generally posts information and that is availableto the public or that clearly describes how the public may accesssuch data within 15 days of producing or obtaining such video oraudio recording. The bill includes exceptions to such release. Thebill also provides that any person denied the rights and privilegesconferred may proceed to enforce such rights and privileges by filinga petition for mandamus or injunction pursuant to the Virginia Freedomof Information Act.

Teacher compensation; at or above national average.Requires that public school teachers be compensated at a rate thatis at or above the national average. Under current law, compensationat such rate is aspirational. The bill requires state funding tobe provided pursuant to the general appropriation act in a sum sufficientto fund a 4.5 percent annual increase for public school teacher salaries,effective from the 2022-23 school year through the 2026-27 schoolyear. The bill has a delayed effective date of July 1, 2022.

Constitutional amendment (first reference);marriage; repeal of same-sex marriage prohibition; recognition ofsame-sex marriages. Repeals the constitutional provision definingmarriage as only a union between one man and one woman, as well asthe related provisions that are no longer valid as a result of theUnited States Supreme Court decision in Obergefell v. Hodges,576 U.S. 644 (2015). The amendment provides that the Commonwealthand its political subdivisions and its agents are required to issuemarriage licenses, recognize marriages, and treat all marriages equallyunder the law, regardless of the gender of the two parties to themarriage. The amendment further provides that religious organizationsand clergy acting in their religious capacity have the right to refuseto perform any marriage.
