State Corporation Commission; electric utility infrastructure; report. Directs the Department of Energy (the Department) and the State Corporation Commission (the Commission) to conduct a comprehensive analysis of existing electric utility infrastructure to identify cost-saving opportunities that improve or preserve electric system reliability as an alternative or supplement to greenfield infrastructure projects. The bill requires the Department and the Commission to complete their analysis and submit a report to the General Assembly no later than July 1, 2027.

Public schools; indoor air quality; industry-recognized uniform inspection and evaluation. Adds several items that are required to be included in the industry-recognized uniform inspection and evaluation of the heating, ventilation, and air conditioning system that is required at least every four years for each public elementary and secondary school building, including measurement of radon levels in the air and testing for moisture incursion. The bill has a delayed effective date of July 1, 2027.

Retail sales and use tax; exemption for data centers. Requires a data center operator, in order to be eligible for the existing data center sales and use tax exemption, to (i) beginning July 1, 2027, not use co-located generating facilities that emit carbon dioxide, other than backup generators; (ii) beginning July 1, 2029, contract for a certain percentage of energy, capacity, and renewable energy certificates from clean energy resources, as evidenced by a certification from the State Corporation Commission, or contracts and service agreements; (iii) utilize only non-carbon dioxide-emitting backup power sources, such as energy storage resources, beginning on a date dependent on the data center's initial service date; and (iv) demonstrate, for any new data center issued a final certificate of occupancy or its equivalent on or after January 1, 2030, or for any data center operator seeking an amended memorandum of understanding, sufficient investment in environmental management and energy efficiency measures to provide system-wide benefits, as defined in the bill. Finally, the bill has a delayed effective date of July 1, 2027.

Innovative Internship Fund and Program; local government employers and matching funds. Adds local government employers to those eligible for institutional grants and matching funds through the Innovative Internship Fund and Program.

Health insurance; State Plan for Medical Assistance; coverage for prosthetic and custom orthotic devices and components; reports. Amends provisions related to health insurance coverage for prosthetic devices and components to include custom orthotic devices and components. Under the bill, such coverage does not include repair and replacement due to theft or loss and may include more than one prosthetic or custom orthotic device when medically necessary, as determined by an enrollee's provider. The bill prohibits an insurer from denying coverage for a prosthetic or custom orthotic device for an individual with limb loss, limb absence, or limb impairment that would otherwise be covered for a nondisabled individual seeking medical or surgical intervention. The bill requires health plans that provide such coverage to include language describing an enrollee's rights related to coverage for prosthetic and custom orthotic devices and provide a written explanation of any claim denials. The bill also directs the Department of Medical Assistance Services to seek the necessary permissions from the Centers for Medicare and Medicaid Services to provide payment of medical assistance for prosthetic and custom orthotic devices, subject to the same requirements as insurers. Such payment is conditional on the Department obtaining all necessary approvals and federal financial participation. The bill sunsets on July 1, 2027, if such approval and federal financial participation is not obtained. The bill directs the health insurance carriers, the Department of Medical Assistance Services, and any managed care plan administering Medicaid benefits in the Commonwealth to submit reports to the Health Insurance Reform Commission regarding implementation of the provisions of the bill during plan years 2027 and 2028.

Department of Energy; energy generation and storage by data centers; work group; report. Directs the Department of Energy to convene a work group to study the cost and feasibility of (i) energy generation by data centers, (ii) the use of such energy generation to serve as backup or primary generation for data centers, and (iii) the use of energy storage resources by data centers in the Commonwealth. The work group shall also examine the potential for partnerships with public universities to support the development of advanced energy technologies. The work group shall submit a report of its findings and recommendations to the General Assembly by September 1, 2026.

Secretary of Transportation; review of the VDOT's approval process for projects involving buildings, road development, and other construction; report. Directs the Secretary of Transportation to (i) conduct a review of the Department of Transportation's approval process for projects involving buildings, road development, and other construction and (ii) submit a summary of his review and a report of his findings to the Chairs of the House and Senate Committees on Transportation no later than December 1, 2026.
