Earned sentence credits; revocation of suspended sentence. Clarifies that sentences for certain crimes that as of July 1, 2022, will be subject to a maximum of 4.5 earned sentence credits for each 30 days served include a suspended sentence that is revoked for any such crime. This bill is declarative of existing law.

Protective orders; violations of preliminary child protective order, changes punishment, etc.

Violations of protective orders; preliminarychild protective order. Changes the punishment and sentencingrequirements for a violation of a preliminary child protective orderso that the maximum penalty is a Class 1 misdemeanor and the courtis no longer required to enter a permanent family abuse protectiveorder (i.e., a protective order with a maximum duration of two years)upon a conviction of a violation of a preliminary child protectiveorder. The bill provides that a violation of a preliminary child protective order is punishable as contempt of court; however, if theviolation involves an act or acts of commission or omission that endanger the child's life, health, or normal development or resultin bodily injury to the child, it is punishable as a Class 1 misdemeanor.Under current law, violations of preliminary child protective ordersconstitute contempt of court and are also subject to the same penaltiesas violations of preliminary, emergency, and permanent family abuseprotective orders, including enhanced penalties for certain violations.This bill is a recommendation of the Virginia Criminal Justice Conference.

License plates, special; removes fee for issuance to Va. National Guard retirees.

Special license plates; Virginia National Guardretirees. Removes the fee for the issuance of a special licenseplate for retired members of the Virginia National Guard. Currently,such special license plates cost the same as the prescribed costfor a typical Virginia license plate.

Southwestern Va. Mental Health Institute; Governor to lease a portion of property to Smyth County.

Disposition of property previously used by the Department of Behavioral Health and Developmental Services as the Southwestern Virginia Mental Health Institute. Authorizes the Governor to lease a portion of property previously used by the Department of Behavioral Health and Developmental Services as the Southwestern Virginia Mental Health Institute to Smyth County in as-is condition for a term of three years upon such terms and conditions as may be agreed by the parties, including, without limitation, Smyth County's responsibility for building or infrastructure refurbishments and operational expenses. The bill also corrects tax map references from a 2019 conveyance of property in Smyth County.
