Commending the Honorable Clyde H. Perdue, Jr.

Department of Criminal Justice Services; licensureand regulation of charitable bail organizations. Provides forlicensure and regulation by the Department of Criminal Justice Services of "charitable bail organizations," defined in the bill as any entitythat solicits monetary donations from the public and agrees to usethe money solicited to provide bail or post bond for any person.

Search warrants; daytime execution; exceptions.Provides an exception to the requirement that a search warrantbe executed only in the daytime if, prior to the issuance of thesearch warrant, law-enforcement officers lawfully entered and securedthe place to be searched and subsequently have remained at such placecontinuously. The bill provides that such search warrant may be executedat any time of day without authorization from a judge or magistrate.The bill also allows a law-enforcement officer to seek authorizationfrom a magistrate to execute a search warrant at a time other thandaytime without first having to make reasonable efforts to locatea judge if such search warrant was issued after 5 p.m.

Emergency Services and Disaster Law; limitationon duration of executive orders. Limits the duration of any rule, regulation, or order issued by the Governor pursuant to his powersunder the Emergency Services and Disaster Law to no more than 60days from the date of issuance. The bill provides that if the GeneralAssembly does not take any action on such rule, regulation, or orderwithin the 60 days during which the rule, regulation, or order iseffective, the Governor shall thereafter be prohibited from issuingthe same or a similar rule, regulation, or order relating to thesame emergency. Under current law, once issued, such executive ordersare effective until June 30 following the next regular session ofthe General Assembly.

Assistance to certain voters; curbside voting;right to observe ballot deposited into ballot scanner machine orballot container. Provides that, upon the request of the voter,a curbside voter shall be permitted to enter the polling place aftermarking his ballot in order to observe his ballot being depositedinto the ballot container or ballot scanner machine.

Mandatory outpatient treatment; criteria.Eliminates the requirement that a person have a history of lack ofcompliance with treatment for mental illness that has, at least twicewithin the previous 36 months, resulted in the person being subjectto an order for involuntary admission to be eligible for mandatoryoutpatient treatment following a period of involuntary inpatienttreatment.

Department of Education; pilot program; feasibility ofeducational placement transition of certain students with disabilities.Requires the Department of Education and relevant local school boards todevelop and implement a pilot program for the transition of students who areeducated in private school settings pursuant to Individualized EducationPrograms to the appropriate public school setting in the relevant local schooldivision for up to four years in two to eight local school divisions in theCommonwealth. In developing the pilot, the Department is required to partnerwith the appropriate school board employees in each such local school divisionto (i) identify the resources, services, and supports required by each studentwho resides in each such local school division and who is educated in a privateschool setting pursuant to his Individualized Education Program; (ii) study thefeasibility of transitioning each such student from his private school settingto an appropriate public school setting in the local school division andproviding the identified resources, services, and supports in such publicschool setting; and (iii) recommend a process for redirecting federal, state,and local funds, including funds provided pursuant to the Children's ServicesAct, provided for the education of each such student to the local schooldivision for the purpose of providing the identified resources, services, andsupports in the appropriate public school setting. The bill requires theDepartment of Education to make a report to the Governor, the Senate Committeeson Education and Health and Finance, and the House Committees on Education andAppropriations on the findings of the pilot program after two and four years.

Regional alternative education programs; funding.Requires the funding transferred from the Department of Educationto the relevant school divisions in support of a regional alternativeeducation program to be based on each such school division's needfor the current school year. Under current law, such funding is transferredbased on data accumulated during the prior school year.
