Department of Behavioral Health and DevelopmentalServices; facilities licensed to provide inpatient substance usedisorder treatment; certified discharge plans. Directs the Departmentof Behavioral Health and Developmental Services to amend its regulationsto require that any facility licensed by the Department to provideinpatient substance use disorder treatment be required to prepareand record a certified discharge plan upon the discharge or withdrawalof any individual from the facility who has received substance usedisorder treatment while admitted to such facility. The bill requiressuch discharge plan to include the provision of funds withheld fromthe individual's prior payments to the facility to assist the individualin the execution of such discharge plan. The bill requires the regulationsto provide that failure by a facility to prepare and record certifieddischarge plans may result in civil penalties, license suspension,or license revocation.

Written complaints; felony offenses. Provides that a written complaint is required for a felony offense, regardless of whether the complainant is a law-enforcement officer. Current law only requires a written complaint for any offense if the complainant is not a law-enforcement officer. The bill also provides that if no arrest warrant is issued in response to a written complaint made by a complainant, whether the complainant is a law-enforcement officer or not, the written complaint shall be returned to the complainant.

Pro tempore judicial appointments; criminal background checks; financial disclosure. Requires that prior to an appointment as a pro tempore judge, a person submit his fingerprints for a national and Virginia criminal history record search, submit to a search of the central registry maintained by the Department of Social Services for founded complaints of child abuse and neglect, and provide a written statement of economic interests. The bill prohibits any person with a criminal felony conviction from being appointed as a pro tempore judge.

Charter; Town of Pulaski. Amends the charter for the Town of Pulaski in Pulaski County to reflect the town's shift from May to November municipal elections. The bill clarifies that the town council's membership consists of seven members, including the mayor, and provides that the mayor may vote in the council. The bill also changes the time of the election of the vice-mayor from even-numbered years to odd-numbered years at the first meeting of the council. This bill is identical to SB 475.

Law-enforcement officers; exposure to bodilyfluids; petition to the general district court by local attorney for the Commonwealth. Allows a local attorney for the Commonwealthin the county or city in which such exposure occurred to file a petitionfor an order requiring testing and disclosure of test results onbehalf of a law-enforcement officer when a law-enforcement officer is directly exposed to the bodily fluid of a person in a manner thatmay, according to the then-current guidelines of the Centers forDisease Control and Prevention, transmit human immunodeficiency virusor hepatitis B or C viruses and such person refuses to submit to testing. Current law limits who may file a petition to the exposed law-enforcement officer or his employer.
