Board of zoning appeals; appointments. Providesan exception to the general rule that an elected official cannotbe appointed to a board of zoning appeals by allowing an electedofficial from a town to serve on the board of zoning appeals of thecounty in which the member also resides.
Sales and use tax exemption for data centers. Reduces to four new jobs, for purposes of qualifying for the sales and use tax exemption for data centers, the job creation requirement for a data center in a distressed locality. Under current law, such data centers must create at least 25 new jobs. The bill lowers the amount of investment needed to qualify for the exemption from $150 million to $1.9 million for data centers that qualify for the reduced jobs requirement. The bill also redefines what criteria are used to identify a distressed locality such that a locality qualifies as distressed if it has an unemployment rate that is greater than the statewide unemployment rate and it also has a poverty rate that exceeds the statewide poverty rate. The bill requires all data centers claiming the exemption to submit an annual report detailing certain information to the Virginia Economic Development Partnership Authority (the Authority). Finally, the requires the Department of Taxation (the Department), in collaboration with the Authority to publish a biennial report on the exemption. Such report by the Department shall not include any unaggregated or other information that could be used to identify a business or individual.
Special license plates; Virginia National Guardretirees. Removes the fee for the issuance of a special licenseplate for retired members of the Virginia National Guard. Currently,such special license plates cost the same as the prescribed costfor a typical Virginia license plate.

Special license plates; NOT FORGOTTEN. Authorizesthe issuance of revenue-sharing special license plates for supportersof Americans listed as prisoners of war or missing in action bearingthe legend NOT FORGOTTEN. The bill requires that the design of suchplate incorporate the POW/MIA Flag as designated by the federal NationalPOW/MIA Flag Act. The bill exempts these special license plates fromthe requirement to obtain 450 prepaid applications for such plate.The bill provides that some of the license plate fees will be depositedin the POW/MIA Fund, established within the Department of Accounts,and paid annually to the National League of Families of American Prisonersand Missing in Southeast Asia and used to support its operation andprograms in Virginia.
Special license plates; SPEARHEAD TRAILS.Authorizes the issuance of revenue-sharing special license platesfor supporters of the Southwest Regional Recreation Authority bearingthe legend SPEARHEAD TRAILS. The bill exempts these special licenseplates from the requirement to obtain 450 prepaid applications forsuch plate.
Virginia Adventure Corridor and Trail Authority.Establishes the Virginia Adventure Corridor and Trail Authorityas a political subdivision of the Commonwealth. The Authority ischarged with recreational trail development in the southwest regionSouthwest Region of the Commonwealth and is governed by a Board comprisedof members appointed from 13 counties and cities in the region.
