Voter registration; regular periodic review of registration records. Requires the Department of Elections to complete, not later than 90 days prior to the date of a primary or general election, any program the purpose of which is to systematically remove the names of ineligible voters from the voter registration system based on evidence of ineligibility, including evidence of lack of eligible residence or evidence of noncitizenship. This restriction is not to be construed to preclude (i) the removal of names from the voter registration system at the request of the registrant or as provided by existing law by reason of criminal conviction or mental incapacity or the death of the registrant if the triggering conviction, incapacity order, or death occurred within 120 days of the election or (ii) the correction of details, such as name and address, in a voter's registration record that does not result in the removal of a voter from the voter registration system. Under current law, such restriction only applies to federal primaries and federal general elections. The bill also provides a process for confirming a voter's citizenship status prior to cancellation based on a report of non-citizen status and extends (a) the period of time registrars have to cancel registrations from 30 days to 60 days after notification of the need to cancel by the Department of Elections and (b) the period of time a registered voter has to respond to a notice of cancellation related to citizenship status from 14 days to 28 days.
Memorializing Congress; National Infrastructure Bank. Urges the Congress of the United States to create a National Infrastructure Bank to finance urgently needed infrastructure projects.
Virginia Private College Preservation and Maintenance Fund and Program established. Establishes the Virginia Private College Preservation and Maintenance Fund and Program, to be administered by the State Council of Higher Education for Virginia in collaboration with the Council of Independent Colleges in Virginia and the Department of Historic Resources, for the purpose of awarding grants on a competitive basis to any nonprofit private institution of higher education whose primary purpose is to provide collegiate, graduate, or professional education and not to provide religious training or theological education to assist with the funding of renovation, restoration, repair, preservation, and deferred maintenance projects, with certain enumerated conditions such as providing sufficient evidence of matching funds for the project in an amount equal to the amount of the grant to be awarded and providing certain documentation and project monitoring for projects involving certified historic structures, as defined in the bill.
Consumer Data Protection Act; definition of "biometric data"; consent required for processing biometric data. Provides that, under the Consumer Data Protection Act, no consumer, controller, processor, or affiliate of the controller or processor shall process biometric data, defined separately in the bill, concerning an individual without obtaining the individual's consent, or, in the case of the processing of biometric data concerning a known child, without processing such data in accordance with the federal Children's Online Privacy Protection Act.
Removal hearings; foster care; termination of parental rights; status as an Indian child; reasonable efforts; definition; services to families. Adds a definition of reasonable efforts for the purposes of hearings relating to the foster care of and petitions for the termination of parental rights over those children who are not determined to be a member of a Virginia-recognized or federally recognized tribe. The bill further requires that, at a preliminary removal hearing, or as soon as possible thereafter, and prior to any adjudicatory hearing, the court shall make a finding as to whether diligent efforts have been made to determine whether the child is an Indian child as defined in the Indian Child Welfare Act or a member of, or eligible for membership in, a tribe recognized by the Commonwealth. Under the bill, any such children would receive the protections of the Indian Child Welfare Act, including the federal standard of active efforts. The bill further directs the Department of Social Services to promulgate new regulations defining types of abuse and neglect, specifying that in situations where neglect is the result of family poverty and there are no outside resources available to the family, the parent or caretaker shall not be determined to have neglected the child, but the local department of social services shall provide appropriate and timely services to the family.
Access to Housing Task Force; report. Establishes the Access to Housing Task Force for the purpose of evaluating short-term and long-term access to housing in the Commonwealth. The bill directs the Task Force to report its findings and recommendations to the Governor and General Assembly no later than November 1, 2026.
Comprehensive children's health care coverage program. Directs the Department of Medical Assistance Services (the Department) to establish a program to provide state-funded comprehensive health care coverage for individuals in the Commonwealth who are (i) under 19 years of age and (ii) not covered under a group health plan or health insurance coverage, or otherwise eligible for medical assistance services through the Commonwealth's program of medical assistance services established pursuant to Title XIX or XXI of the Social Security Act. The bill also requires the Department to ensure that all program information is made available in a manner that is accessible to individuals with limited English proficiency and individuals with disabilities through the provision of language access services, including oral interpretation and written translation, free of charge and to ensure that information obtained by the program remains confidential and is not disclosed for any purpose not related to the administration of the program or any purpose related to civil immigration enforcement unless the subject of the information consents to such disclosure or the requesting agency presents a valid judicial order, subpoena, or warrant. The bill requires the Department to seek all federal waivers and other approvals necessary to maximize federal financial participation in the cost of carrying out the program established by the bill.
Income tax; credit for certain health care providers. Provides, for taxable years 2026 through 2030, a nonrefundable individual income tax credit for eligible health care providers, defined in the bill, who provide health care in an underserved community during the taxable year. The bill defines "underserved community" as an area within the Commonwealth identified by the Board of Health as medically underserved. The amount of the credit shall equal $5,000 if the eligible health care provider provided at least 1,600 hours of health care in an underserved community during the taxable year or $2,500 if the eligible health care provider provided at least 800 hours of health care in an underserved community during the taxable year. The bill provides that such providers shall only be allowed to claim such credit for two taxable years. The aggregate amount of credits allowable under the provisions of the bill shall not exceed $5 million per taxable year.
Average teacher salary in the Commonwealth; national average. Requires the Governor's introduced budget bills for the 2027 and 2028 Regular Sessions of the General Assembly to propose funding for, and state funding to be provided pursuant to the general appropriation act enacted during any regular or special session of the General Assembly during 2027 or 2028 to fund, the Commonwealth's share of compensation supplement incentives for Standards of Quality-funded instructional and support positions sufficient to increase the average teacher salary in the Commonwealth to at least the national average teacher salary by the end of fiscal year 2029 and establishes a detailed timeline and process for satisfying such requirement.
