Trigger activators; prohibition, penalty.

Trigger activators; prohibition; penalty. Prohibitsthe manufacture, importation, sale or offer to sell, possession,transfer, or transportation of a trigger activator, defined in thebill as (i) a device designed to be attached to a semi-automaticfirearm, which allows the firearm to discharge two or more shotsin a burst by activating the device, including a bump-fire deviceor a binary trigger, but does not convert the semi-automatic firearminto a machine gun or (ii) a manual or power-driven trigger activatingdevice designed so that when attached to a semi-automatic firearmit increases the rate of fire of that firearm, including a triggercrank, but does not convert the semiautomatic firearm into a machine gun. A violation is punishable as a Class 6 felony.

Juvenile offenders; eligibility for parole.

Juvenile offenders; parole. Provides that any person sentenced to a term of life imprisonment for a single felony offense or multiple felony offenses committed while that person was a juvenile and who has served at least 20 years of such sentence and any person who has active sentences that total more than 20 years for a single felony offense or multiple felony offenses committed while that person was a juvenile and who has served at least 20 years of such sentences shall be eligible for parole. This bill is identical to HB 35.

Workers' compensation; repetitive motion injuries.

Workers' compensation; repetitive motion injuries.Provides that a physical injury, including the condition of carpaltunnel syndrome, that results from repetitive motion shall be treatedas an injury by accident for purposes of the Virginia Workers' CompensationAct. The bill also removes a provision that declares carpal tunnelsyndrome to be an ordinary disease of life.

School meal debt; donations.

School meal debt; donations. Permits anyschool board to solicit and receive any donation or other funds forthe purpose of eliminating or offsetting any school meal debt atany time during the school year and requires each school board touse any such funds solely for such purpose, provided, however, thatno such funds are obtained in an illegal or illicit manner. The billprovides that if a school board receives a donation that does notentirely eliminate or offset the total school meal debt at any timeduring the school year, the school board shall distribute the donation proportionately among each school meal debt.

Possession of tobacco products, nicotine vaporproducts, and alternative nicotine products by persons under 21 yearsof age; exception; scientific study. Provides an exception tothe law prohibiting possession of tobacco products, nicotine vaporproducts, or alternative nicotine products by a person less than21 years of age when such possession is part of a scientific studybeing conducted by an organization for the purpose of medical researchto further efforts in cigarette and tobacco use prevention and cessationand tobacco product regulation, provided that such medical researchhas been approved by an institutional review board pursuant to applicablefederal regulations or by a research review committee.

Department of Motor Vehicles; sex designation. Requires the Department of Motor Vehicles to offer any applicant the option to mark "male," "female," or "non-binary" when designating the applicant's sex on an application for a driver's license or special identification card.

School boards; distribution of excess food.

School boards; distribution of excess food. Allows public school boards to distribute excess food to students eligible for the School Breakfast Program or National School Lunch Program administered by the U.S. Department of Agriculture or to students who the school board determines are otherwise eligible to receive excess food. A school board is also allowed to develop a policy for distributing excess food, saving it for later, or donating it.

Recounts; special election to be held in the case of a tie vote, exception.

Recounts; special election to be held in the case of a tie vote. Provides that if, after a recount of an election, the recount court finds that each party to the recount has received an equal number of votes, there shall be a special election to determine which candidate is elected to the office. This provision would not apply in cases of tie votes occurring after a recount of an election for Governor, Lieutenant Governor, or Attorney General, which the Constitution of Virginia provides for, or for electors of President and Vice President of the United States, which will continue to be determined by lot. This bill incorporates HB 178 and HB 692.

Workers' compensation; presumption of compensability for certain diseases, conditions before 7/1/20.

Workers' compensation; presumption of compensability for certain diseases. Adds cancers of the colon, brain, or testes to the list of cancers that are presumed to be an occupational disease covered by the Virginia Workers' Compensation Act when firefighters or certain employees develop the cancer. The presumption shall not apply for any individual who was diagnosed with one of the conditions before July 1, 2020. The measure removes the compensability requirement that the employee who develops cancer had contact with a toxic substance encountered in the line of duty. The bill also reduces the number of years of service needed to qualify for the presumption from 12 to five for various types of cancer. For hypertension or heart disease, the bill adds a requirement that an individual complete five years of service in their position in order to qualify. This bill is identical to SB 9.
