Virginia Housing Development Authority; powerto make loans; loans to finance payments on student debt. Permitsthe Virginia Housing Development Authority (HDA) to make mortgage loans, including federally insured mortgage loans, to finance thepurchase or refinancing of single-family residential housing andto make payments on the homeowner's student loan debt, upon the termsand conditions set forth in the bill. The bill also gives the HDAauthority to promulgate additional terms and conditions related tosuch loans. The bill includes technical changes.

Constitutional amendment (first resolution);marriage. Proposes the repeal of the constitutional amendmentdealing with marriage that was approved by referendum at the November2006 election. That amendment to the Bill of Rights (i) defines marriage as "only a union between one man and one woman"; (ii) prohibits theCommonwealth and its political subdivisions from creating or recognizing"a legal status for relationships of unmarried individuals that intendsto approximate the design, qualities, significance, or effects ofmarriage"; and (iii) prohibits the Commonwealth or its politicalsubdivisions from creating or recognizing "another union, partnership,or other legal status to which is assigned the rights, benefits,obligations, qualities, or effects of marriage." The provisions ofthis section of the Constitution of Virginia are no longer validas a result of the United States Supreme Court decision in Obergefellv. Hodges, 576 U.S. ___ (June 26, 2015).
Protective orders; prohibited contact; remotecontrol of appliance, utility, or device by electronic device. Clarifiesthat a court entering a protective order may, as a condition of suchprotective order, prohibit the respondent from using any electronicdevice to remotely control any appliance, utility, or device locatedon or within the petitioner's residence or the curtilage thereof.
Virginia Minimum Wage Act; exemption. Removesthe exemption from the Virginia Minimum Wage Act for persons employedin domestic service or in or about a private home or in an eleemosynaryinstitution primarily supported by public funds.
Minimum wage; exemptions. Removes the exemptionfrom the Virginia Minimum Wage Act for individuals who are employedby an employer that does not have four or more persons employed atany one time.
Possessing or transporting a weapon withinCapitol Square; penalty. Makes it a Class 1 misdemeanor for a person to possess or transport any (i) gun or other weapon designedor intended to propel a missile or projectile of any kind; (ii) frame,receiver, muffler, silencer, missile, projectile, or ammunition designedfor use with a dangerous weapon; or (iii) other dangerous weapon within Capitol Square, which includes the state-owned buildingsthat border its boundary streets. A dangerous weapon includes a bowieknife, switchblade knife, ballistic knife, machete, razor, slingshot,spring stick, fighting chain, throwing star, and oriental dart orany weapon of like kind. The bill provides exceptions for law-enforcementofficers, conservators of the peace, magistrates, court officers,judges, county or city treasurers, commissioners or deputy commissionersof the Virginia Workers' Compensation Commission, authorized securitypersonnel, and active military personnel while in the conduct ofsuch individuals' official duties. The bill requires that noticeof the provisions prohibiting the possessing or transporting of suchweapons be posted at each public entrance to Capitol Square. Thebill provides that any weapon or item possessed or transported inviolation of these provisions is subject to seizure by a law-enforcementofficer and forfeiture to the Commonwealth.
Petition for vacatur and expungement of convictionsand police and court records of victims of human trafficking.Allows any person who was a victim of human trafficking at the timeof an offense that led to a criminal charge or conviction of certaincrimes to petition the court to vacate such conviction and expungethe police and court records related to such conviction or to expungethe police and court records related to such charge. The bill provides that there is a rebuttable presumption that a person's participationin an offense was a result of having been a victim of human traffickingif there is official documentation, defined in the bill, of the petitioner'sstatus as a victim of human trafficking at the time of the offense.
General Assembly meetings; streaming and recording. Requires the Clerk of the House of Delegates and the Clerk of theSenate to ensure that every (i) subcommittee or committee meetingof a standing committee of the General Assembly, regardless of meetingdate, and (ii) floor session of the House of Delegates or the Senate,including any joint session of the houses, is streamed with closedcaptioning, recorded and archived. The bill defines "stream" and specifiesthat a qualifying meeting is one the date and time of which havebeen scheduled on a public website of any agency of the General Assemblyfor at least one hour prior to the meeting and that takes place inthe State Capitol, the Pocahontas Building, or the General AssemblyBuilding in Richmond. The bill has a delayed effective date of October1, 2020.
Prisoners; medical care. Eliminates theDepartment of Corrections prisoner co-payment program for nonemergencyhealth care services.
Coverage for reproductive health services. Requireshealth benefit plans to cover the costs of specified health care services,drugs, devices, products, and procedures related to reproductive health,including (i) well-woman preventive visits; (ii) counseling for sexuallytransmitted infections; (iii) screening for certain conditions; (iv) folic acidsupplements; (v) breastfeeding support, counseling, and supplies; (vi) breastcancer chemoprevention counseling; (vii) contraceptive drugs, devices, orproducts; (viii) voluntary sterilization; and (ix) any additional preventiveservices for women that must be covered without cost sharing under federal lawas of January 1, 2019. The mandated coverage does not include abortion servicesother than when performed when the life of the mother is endangered by aphysical disorder, physical illness, or physical injury, including alife-endangering physical condition caused by or arising from the pregnancyitself, or when the pregnancy is the result of an alleged act of rape orincest. The measure provides an exemption for plans sold to religiousemployers. Carriers are prohibited from excluding a covered person fromparticipating in, being denied the benefits of, or otherwise being subjected todiscrimination in the coverage of or payment for reproductive health services,and a violation constitutes an unfair trade practice. The health benefit planrequirements become effective when a plan is delivered, issued for delivery, reissued,or extended in the Commonwealth on and after January 1, 2021, or at any timethereafter when any term of the health benefit plan is changed or any premiumadjustment is made.
