Virginia Public Procurement Act; project laboragreements. Requires every public body, prior to requiring bidders,offerors, contractors, subcontractors, or operators on public workscontracts to enter into, become or remain signatories to, or adhereto project labor agreements, to make a written determination thatrequiring such bidders, offerors, contractors, subcontractors, oroperators to enter into, become or remain signatories to, or adhereto such project labor agreements advances the public's interestsbased on objective criteria established by the public body by regulationor ordinance, such as cost, efficiency, quality, safety, timeliness,maintenance of a skilled labor force, labor stability, or advancing minority-owned and women-owned business participation in the project.

Control of firearms by localities. Removes the authority for a locality by ordinance to prohibit the possession or carrying of firearms, ammunition, or components or any combination thereof in (i) any building, or part thereof, owned or used by such locality for governmental purposes; (ii) any public park owned or operated by the locality; (iii) any recreation or community center facility; or (iv) any public street, road, alley, or sidewalk or public right-of-way or any other place of whatever nature that is open to the public and is being used by or is adjacent to a permitted event or an event that would otherwise require a permit. The bill provides that any firearm received by the locality pursuant to a buy-back program shall be offered for sale by public auction or sealed bids to a person licensed as a dealer. Current law provides that any such firearm shall be destroyed by the locality unless the person surrendering the firearm requests in writing that the firearm be offered for sale. The bill also limits the authority of localities and state governmental entities to bring lawsuits against certain firearms manufacturers and others.

Department of Education; policy on sexually explicit content in instructional material. Requires the Department of Education to develop and each local school board to adopt model policies for ensuring parental notification of any instructional material that includes sexually explicit content and include information, guidance, procedures, and standards relating to (i) ensuring parental notification; (ii) directly identifying the specific instructional material and sexually explicit subjects; and (iii) permitting the parent of any student to review instructional material that includes sexually explicit content and provide, as an alternative, nonexplicit instructional material and related academic activities to any student whose parent so requests. The bill provides that the local school board model policies may be more comprehensive than the model policies developed by the Department. The bill requires the Department to develop such model policies no later than July 31, 2022, and requires each local school board to adopt policies consistent with this act no later than January 1, 2023. The bill states that the provisions of the bill shall not be construed as requiring or providing for the censoring of books in public elementary and secondary schools.
Absentee voting; unsolicited absentee ballotapplications; required information. Requires any individual ororganization sending an application for an absentee ballot to a registeredvoter that was not solicited or requested by the registered voterto include with the application instructions on completing the applicationand submitting it to the appropriate general registrar. The billrequires a statement that the application is not being sent by anystate or local government official or agency on the envelope containingthe application or on the first page of any enclosed materials. Suchindividuals and organizations are required to use the informationprovided in the list of registered voters acquired by such individualor organization from the Department of Elections pursuant to law, and a violation of this requirement is a Class 4 misdemeanor. Thebill requires the Department of Elections to ensure, when providingthe list of registered voters to such individual or organization for purposes of sending unsolicited absentee ballot applications, thatno voter is included on the list provided if such voter has appliedfor an absentee ballot on or before the date the list is requested.The bill also provides that no absentee ballot sent to a registeredvoter that was not solicited or requested by the registered votermay be pre-populated with information the applicant is required toprovide.
Voter identification; identification containinga photograph required. Requires presentation of a form of identificationcontaining a photograph in order to vote. The bill repeals the provisionsof law permitting a voter who does not have one of the required formsof identification to vote after signing a statement, subject to felonypenalties for false statements, that he is the named registered voterhe claims to be. Instead, the bill provides that such voter is entitledto cast a provisional ballot.
