Voter identification; identification containinga photograph required. Requires presentation of a form of identification containing a photograph in order to vote. The bill repeals the provisionsof law permitting a voter who does not have one of the required formsof identification to vote after signing a statement, subject to felony penalties for false statements, that he is the named registered voterhe claims to be. Instead, such voter would be entitled to cast aprovisional ballot.

Special license plates; NOT FORGOTTEN. Authorizesthe issuance of revenue-sharing special license plates for supportersof Americans listed as prisoners of war or missing in action bearingthe legend NOT FORGOTTEN. The bill requires that the design of suchplate incorporate the POW/MIA Flag as designated by the federal NationalPOW/MIA Flag Act. The bill exempts these special license plates fromthe requirement to obtain 450 prepaid applications for such plate.The bill provides that some of the license plate fees will be depositedin the POW/MIA Fund, established within the Department of Accounts,and paid annually to the National League of Families of American Prisonersand Missing in Southeast Asia and used to support its operation andprograms in Virginia.

In-person instruction; education vouchers; emergency. Requires, in the event that any school board does not provide theoption of in-person instruction as the sole method of instruction for any enrolled student, the parent of any such student who withdraws his child from attendance to receive, upon request, an educationvoucher in an amount equal to a prorated share of the applicableStandards of Quality per-pupil state funds appropriated for publicschool purposes and apportioned to the school division, includingthe per-pupil share of state sales tax funding in basic aid and anystate per-pupil share of special education funding for which thechild is eligible, to cover the expenses of providing in-person instructionin an alternative setting. The bill permits the Department of Educationto establish rules, regulations, or procedures for the issuance ofsuch education vouchers. The bill contains an emergency clause.

Unborn child protection from dismembermentabortion; penalties. Prohibits the practice of dismembermentabortion, which is defined in the bill as meaning to, with the purposeof causing the death of an unborn child, purposely dismember a livingunborn child and extract him one piece at a time from the uterusthrough the use of clamps, grasping forceps, tongs, scissors, orany other instrument that, through the convergence of two rigid levers,slice, crush, or grasp a portion of the unborn child's body to cutor rip such portion of the unborn child's body. The term does notinclude an abortion that uses suction to dismember the body of anunborn child by sucking fetal parts into a collection container,but it does include an abortion in which a dismemberment abortionis used to cause the death of an unborn child but suction is subsequentlyused to extract fetal parts after the death of the unborn child.The bill provides that a person who purposely performs a dismembermentabortion is guilty of a Class 4 felony. A cause of action is alsocreated for injunctive relief and civil damages. An exception is made when a dismemberment abortion is necessary to prevent serioushealth risk to the unborn child's mother.

State agencies; automatic workforce managementverification software. Requires all state agencies with morethan 20 full-time teleworking employees to use automatic workforcemanagement verification software to verify the hours employees worked while teleworking by counting and reporting to the agency all keystroke,mouse event, and screenshot data. The bill requires all such datacollected by the software to be considered personnel records belongingto the agency; however, agencies are prohibited from selling or transferringsuch data or using it for any purpose or in any manner other thanto verify hours worked for the agency.

Regulation of electric utilities; developmentof renewable energy facilities; powers of Air Pollution Control Board;powers of State Corporation Commission. Repeals provisions (i)requiring the Air Pollution Control Board to adopt regulations toreduce carbon dioxide emissions from any electricity generating unitin the Commonwealth and authorizing the Board to establish an auctionprogram for energy allowances; (ii) prohibiting the State CorporationCommission from approving any new utility-owned generation facilitiesthat emit carbon dioxide as a by-product of energy generation, incertain circumstances; (iii) declaring that statutory allowancesfor energy derived from sunlight, onshore wind, offshore wind, and storage facilities are in the public interest; and (iv) relatingto the development of solar and wind generation and energy storagecapacity, development of offshore wind capacity, and generation ofelectricity from renewable and zero carbon sources. The bill providesthat planning and development activities for new nuclear generationfacilities are in the public interest.
