Under current law, public bodies may consider best valueconcepts only when procuring goods and nonprofessional services.
Special license plates; NATIVE AMERICAN HERITAGE.Authorizes the issuance of revenue-sharing special license platesfor supporters of the Native American Rights Fund bearing the legendNATIVE AMERICAN HERITAGE.
Carrying loaded firearms in public while underthe influence of alcohol or illegal drugs; penalties. Providesthat it is a Class 1 misdemeanor for a person under the influenceof alcohol or illegal drugs to carry a loaded firearm on or abouthis person in a public place and that a person found guilty of suchact is ineligible to apply for a concealed handgun permit for a periodof five years. Current law provides that such prohibition appliesonly to persons permitted to carry a concealed handgun.
Suspension of driver's license for nonpaymentof fines or costs. Removes the requirement that a court suspendthe driver's license of a person convicted of any violation of thelaw who fails or refuses to provide for immediate payment of finesor costs. The bill allows a court, after 90 days of nonpayment wherethe court finds the nonpayment was not an intentional refusal toobey the sentence of the court, to provide additional time for payment,reduce the amount of each payment installment, assign community servicein lieu of payment, or waive the unpaid portion in whole or in part. Upon a finding that the nonpayment was an intentional refusal toobey the sentence of the court, a court may suspend the defendant'sdriver's license until payment in full or until the defendant entersinto a payment plan.
Study; DCJS; enforcement of the law prohibitingindividuals subject to permanent protective orders for family abusefrom possessing firearms while such order is in effect; report. Directs the Department of Criminal Justice Services to study the enforcementof the law prohibiting individuals subject to permanent protectiveorders for family abuse from possessing firearms while such orderis in effect.
Study; Virginia Housing Commission; use of dwelling units as family day homes; report. Directs the Virginia Housing Commission to study whether individuals residing in a rental dwelling unit shall be permitted to operate a family day home from within such rental dwelling unit. In conducting its study, the Commission is directed to review (i) the need of families to have access to high-quality, affordable child care; (ii) the unique challenges presented by the operation of a family day home from within a rental dwelling unit; (iii) the concerns of landlords stemming from the use of a dwelling unit as a family day home; and (iv) ways in which the needs of families to have access to affordable, high-quality child care can be reconciled with the concerns of landlords stemming from the use of dwelling units as family day homes.
Historic rehabilitation tax credit. Increasesfrom $5 million to $10 million the maximum amount of the historicrehabilitation tax credit, including amounts carried over from priortaxable years, which may be claimed by a taxpayer in any taxable year.
Study; state parks at Brandy Station and CedarMountain Battlefields; report. Requests the Department of Conservationand Recreation to study the feasibility of establishing two stateparks in Culpeper County, one at Brandy Station Battlefield and oneat Cedar Mountain Battlefield.
Teacher compensation; at or above national average. Requires public school teachers to be compensated at a rate that is at or above the national average. Under current law, compensation at such rate is aspirational. The foregoing provisions of the bill have a delayed effective date of July 1, 2025. The bill requires funding to be provided on an incremental basis pursuant to the general appropriation act to implement such teacher compensation rate by the effective date.
