Provides that a defendant's ignoranceof the victim's age, the victim's misrepresentation of his age, orthe defendant's belief that the victim was an adult shall not beraised as a defense in a prosecution for certain crimes related tocommercial sex trafficking and prostitution involving a minor victim.

Teachers; required to be compensated at or above national average.

Teacher compensation; at or above national average.Requires that public school teachers be compensated at a rate thatis at or above the national average. Under current law, compensationat such rate is aspirational. The bill requires state funding tobe provided pursuant to the general appropriation act in a sum sufficientto fund a 4.5 percent annual increase for public school teacher salaries,effective from the 2023-24 school year through the 2027-28 schoolyear. The bill has a delayed effective date of July 1, 2023.

Broadensthe scope of disclaimer requirements for campaign advertisementsto include electioneering communications, as defined in the bill,and messages advocating for the passage or defeat of a referendum.The bill also requires an advertisement that is an independent expenditureor expressly advocates for the passage or defeat of a referendum,to contain a disclaimer providing the names of the sponsor's three largest contributors or individuals representing a contributor thatis not an individual.

Virginia Residential Landlord and Tenant Act; terms and conditions of rental agreement.

Virginia Residential Landlord and Tenant Act;terms and conditions of rental agreement; automatic renewal; noticeof rent increase. Requires a landlord that owns more than fourrental dwelling units to, in the case of any rental agreement thatprovides for automatic renewal of such agreement, provide separatewritten notice to the tenant notifying the tenant of any increasein rent. The bill provides that such notice shall be provided tothe tenant no less than 30 days before the automatic renewal takeseffect.

Higher educational institutions, public; admission, in-state tuition, and tuition waivers.

Public institutions of higher education; admission, in-state tuition, and tuition waivers; members of certain AmericanIndian tribes. Requires each public institution of higher educationto establish and implement an admissions policy whereby a certainnumber of annual offers of student admission is reserved for individualswho are members of a state-recognized or federally recognized American Indian tribe that is headquartered in the Commonwealth. The billdeclares eligible for in-state tuition charges regardless of domicileany non-Virginia student who is a member of a state-recognized or federally recognized American Indian tribe that is headquarteredin the Commonwealth. The bill also provides that any student whois a member of a state-recognized or federally recognized AmericanIndian tribe headquartered in the Commonwealth and who has been admittedto a public institution of higher education is eligible for a tuitionwaiver up to the amount necessary to cover the last-dollar cost ofthe institution's in-state tuition and mandatory fees after all other federal and state financial aid to which the student is entitledis taken into account.

Income tax, state; creates a nonrefundable tax credit for family caregivers.

Family caregiver tax credit. Creates a nonrefundableincome tax credit for taxable years 2022 through 2026 for expensesincurred by an individual in caring for an eligible family member,defined in the bill, who requires assistance with one or more activitiesof daily living, also defined in the bill. The credit equals 50 percentof eligible expenditures incurred by the caregiver up to $1,000. Inorder to qualify for the credit, the family caregiver must (i) notreceive any compensation or reimbursement for the eligible expendituresand (ii) have federal adjusted gross income that is no greater than$100,000 for an individual or $200,000 for married persons. The billrequires the Tax Commissioner to establish guidelines for claimingthe credit and provides that any unused credit may be carried forwardby the taxpayer for five taxable years following the taxable yearfor which the credit was issued. The bill is a recommendation ofthe Joint Commission on Health Care.

Virginia Residential Landlord and Tenant Act; landlord obligations, tenant safety.

Virginia Residential Landlord and Tenant Act;landlord obligations; tenant safety. Requires a landlord whoowns more than four rental dwelling units, or more than a 10 percentinterest in more than four rental dwelling units, to require allemployees and applicants for employment to submit to fingerprintingand provide personal descriptive information to be forwarded alongwith the employee's or applicant's fingerprints through the CentralCriminal Records Exchange and the Federal Bureau of Investigationfor the purpose of obtaining criminal history record informationregarding such employee or applicant. The bill allows a landlordto disqualify from employment any person who has been convicted ofor found guilty of, or entered a plea of guilty or nolo contendereto, regardless of adjudication, a violent crime committed in anyjurisdiction. The bill also provides that a landlord must (i) establishwritten policies and procedure for the storage and management of,access to, and return of all keys for each rental dwelling unit;(ii) regulate the secure storage of and access to unissued keys;and (iii) maintain a written log for the issuance and return of allkeys. Finally, pursuant to the bill, all relevant landlords must submit certain information on a quarterly basis to the Department of Housingand Community Development to prove compliance with the provisionsoutlined in the bill.
