Renaming Director of Diversity, Equity, and Inclusion as Director of Diversity, Opportunity, and Inclusion. Renames the Director of Diversity, Equity, and Inclusion to the Director of Diversity, Opportunity, and Inclusion. The Director shall (i) develop a sustainable framework to promote inclusive practices across state government; (ii) implement a measurable, strategic plan to increase opportunities for all Virginians; (iii) facilitate methods to turn feedback and suggestions from state employees, external stakeholders, and community leaders into actionable opportunities; (iv) promote ideas, policies, and practices in coordination with the Secretary of Commerce and Trade to expand entrepreneurship and economic opportunities for disadvantaged Virginians, including Virginians living with disabilities; (v) facilitate bringing Virginians of different faiths together in service to their communities and the Commonwealth; (vi) promote free speech and civil discourse in civic life, including viewpoint diversity in higher education in coordination with the Secretary of Education; (vii) promote ideas, policies, and practices to eliminate disparities in prenatal care and to be an ambassador for unborn children; (viii) coordinate with the Secretary of Education to ensure the history of the United States is taught in Virginia honestly, objectively, and completely and to respond to the rights of parents in educational and curricular decision making; and (ix) perform any other responsibilities as assigned by the Governor. The bill makes similar renaming changes for the Office of Diversity, Equity, and Inclusion and the Diversity, Equity, and Inclusion Officer.

Absentee voting; deadline for returning absenteeballot. Requires that an absentee ballot be received before the closing of the polls on election day in order to be counted. Currently,an absentee ballot that is received after the closing of the pollsbut before noon on the third day after the election is counted ifit is postmarked on or before the date of the election.
Project labor agreements; prevailing wage; collective bargaining for employees of local governments. Provides that state agencies, when engaged in procuring products or services or letting contracts for construction, manufacture, maintenance, or operation of public works, paid for in whole or in part by state funds, shall neither require nor prohibit bidders to enter into or adhere to agreements with one or more labor organizations on the public works projects. The bill removes requirements for the payment of prevailing wage for work performed on public works contracts for state agencies. In addition, the bill removes the authority for a locality, by a local ordinance or resolution, to recognize any labor union or other employee association as a bargaining agent of any public officers or employees or to collectively bargain or enter into any collective bargaining contract with any such union or association or its agents.

Multi-jurisdiction grand jury; elder abuse crimes. Adds the following to the list of crimes that a multi-jurisdiction grand jury may investigate: (i) financial exploitation of mentally incapacitated persons and (ii) abuse and neglect of incapacitated adults.
Elections; voter identification containing photographrequired; who may register up to and including the day of the election;availability of absentee voting in person; return of absentee ballots.Requires presentation of a form of identification containing a photograph inorder to vote and provides that a voter who does not have one of the requiredforms of identification is entitled to cast a provisional ballot. The billrepeals a provision that would permit any person who is qualified to registerto vote to do so in person up to and including the day of the election andlimits the persons who are entitled to register to vote after the close ofregistration records to members of a uniformed service of the United States onactive duty, persons who are residing temporarily outside of the United States,and their spouses and dependents. The bill limits the period during whichabsentee voting in person is available from 45 days to the 10 days immediatelypreceding the date of the election, including both Saturdays. The bill requiresthat absentee ballots returned by mail be returned to the office of the generalregistrar by the close of polls on election day and be postmarked on or beforethe Saturday preceding the date of the election. The bill eliminates the use ofdrop-off locations for the return of absentee ballots. The bill requiresabsentee ballot applications to contain the last four digits of the applicant'ssocial security number and provides that the failure of an absentee ballot toinclude a witness signature is a material omission, rendering the ballot void.
Victim of sex trafficking; affirmative defense;writ of vacatur; minors. Makes changes to the definitions ofvictim of sex trafficking used for the purposes of the issuance ofa writ of vacatur and the affirmative defense available to victimsof sex trafficking to include a minor charged with, convicted, oradjudicated delinquent of a qualifying offense in the Commonwealthwho committed such offense while younger than 18 years of age.
Home instruction and private school tax credit.Creates an individual, nonrefundable income tax credit for taxableyears 2022 through 2026, for amounts paid by the parent or legalguardian of a child for the child's home instruction expenses or tuitionfor attending an accredited private school in Virginia. The creditshall equal the lesser of the amount actually paid in the taxableyear for such costs or half of the average state standards of quality funding per student per year. The credit may be taken for instruction-relatedmaterials, courses, or programs used in home instruction or for privateschool tuition. The credit is available for two years per child andcan be carried forward for five taxable years.
