Virginia Public Procurement Act; constructionmanagement and design-build contracting; applicability. Statesthat design-bid-build, defined in the bill, utilizing competitivesealed bidding is the preferred method of procurement for constructionservices in the Commonwealth. Complex projects, defined in the bill,may request an exemption from the provisions of the bill and relevantlaw from the Division of Engineering and Buildings of the Departmentof General Services. The bill requires all documents related to theproposed use of construction management or design-build by state public bodies and institutions of higher education and any available subcontractor opportunities to be posted on eVA. The bill transfersfrom the Department of General Services to the Division of Engineeringand Buildings the authority to evaluate the proposed use of constructionmanagement or design-build by state public bodies and institutions of higher education and specifies that a local governing body mustapprove at a public meeting the use of construction management ordesign-build by a local public body. Finally, the bill prohibits state public bodies, institutions of higher education, and local governing bodies from considering prior construction management or design-build experience of contractors on comparable projects.

Individual income tax; distribution of revenues;local school construction. Requires distribution of one percentof the individual income tax revenues collected from residents ofa locality to be distributed to that locality. The bill requiressuch funds to be used for school construction or renovation purposesand to be repaid to the state if used for any other purpose. Thebill provides that a locality shall be required to maintain its levelof expenditure for public school purposes as a condition of receivingthe income tax revenues; however, a locality may reduce its levelof expenditure to account for a loss of revenues resulting from areduction in machinery and tools taxes or license taxes.
State plan for medical assistance services;certified community health workers; work group. Directs the Departmentof Medical Assistance Services to amend the state plan for medicalassistance services to include a provision for payment for services provided by certified community health workers. The bill directsthe Department to convene a work group of stakeholders to designthe certified community health worker services benefit and to seekfederal approval through a state plan amendment to implement thebenefit.
Virginia Firefighting Personnel and Equipment Grant Program. Establishes the Virginia Firefighting Personnel and Equipment Grant Program for the purpose of providing grants to localities to hire additional firefighters and to improve their firefighting and emergency medical services. The Department of Fire Programs shall administer the Program, and two types of grants shall be made from the Program. The first shall provide grants to localities to increase the number of firefighters. Such grants shall be made for up to three years and shall be used by localities for programs to (i) hire new, additional full-time firefighters; (ii) convert part-time or volunteer firefighters to full-time firefighters; or (iii) recruit and retain volunteer firefighters. The other type of grant shall be provided to localities for improving firefighting and emergency medical services. Authorized uses of grant funds include acquiring firefighting and emergency medical services vehicles and equipment and modifying facilities. For both grants, the funds shall not be used to supplant any funds currently provided by the Commonwealth or by the locality and shall be used to increase the total amount of funds available for the provision of firefighting or emergency medical services.The Department shall report annually, beginning November 1, 2025, to the Governor and the General Assembly information regarding a list of grants, the amount of each approved grant, information on the performance assessment system that the bill directs the Department to create, an evaluation of each grant based on such system, and any other criteria deemed relevant by the Department.
Paid family and medical leave insurance program; notice requirements; civil action. Requires the Virginia Employment Commission to establish and administer a paid family and medical leave insurance program with benefits beginning January 1, 2027. Under the program, benefits are paid to covered individuals, as defined in the bill, for family and medical leave. Funding for the program is provided through premiums assessed to employers and employees beginning January 1, 2026. The bill provides that the amount of a benefit is 80 percent of the employee's average weekly wage, not to exceed 80 percent of the state weekly wage, which amount is required to be adjusted annually to reflect changes in the statewide average weekly wage. The bill caps the duration of paid leave at 12 weeks in any application year and provides self-employed individuals the option of participating in the program.
