Facial recognition technology; authorizationof use by local law-enforcement agencies and public institutionsof higher education. Allows a locality or a public institutionof higher education to authorize a local law-enforcement agency orcampus police department to purchase or deploy facial recognitiontechnology, which is defined in the bill. The bill prohibits a locallaw-enforcement agency or public institution of higher education currentlyusing facial recognition technology from continuing to use suchtechnology without such authorization after July 1, 2021.
Preservation of historic sites. Providesthat any locality utilizing the urban county executive form of government(Fairfax County) may include a provision in its historic preservationordinance requiring public access to an historic area, landmark,building, or structure, or land pertaining thereto, or providing that no subdivision shall occur within any historic district unlessapproved by the review board or, on appeal, by the governing bodyof the locality as being compatible with the historic nature of sucharea, landmarks, buildings, or structures therein with regard to anyparcel or parcels that collectively are (i) adjacent to a navigableriver and a national park, (ii) owned by a common owner exempt fromtaxation, and (iii) in part or as a whole subject to an easementgranted to the National Park Service or Virginia Outdoors Foundationgranted on or after January 1, 1973.
Workers' compensation; presumption of compensabilityfor COVID-19. Establishes a presumption that COVID-19 causingthe death or disability of firefighters, emergency medical servicespersonnel, law-enforcement officers, and correctional officers isan occupational disease compensable under the Workers' CompensationAct. The bill provides that the COVID-19 virus is established bya positive diagnostic test for COVID-19, an incubation period consistentwith COVID-19, and signs and symptoms of COVID-19 that require medicaltreatment. The bill provides that such presumption applies to anydeath or disability occurring on or after March 12, 2020, causedby infection from the COVID-19 virus, provided that for any suchdeath or disability that occurred on or after March 12, 2020, andprior to December 31, 2021, the claimant received a diagnosis ofCOVID-19 from a licensed physician, after either a presumptive positivetest or a laboratory confirmed test for COVID-19, and presented withsigns and symptoms of COVID-19 that required medical treatment.
Virginia Public Procurement Act; requirement to pay prevailing wage; transportation infrastructure projects. Clarifies, for purposes of the requirement under certain circumstances to pay the prevailing wage rate for work performed on public works contracts, that public works includes transportation infrastructure projects..
Probation, revocation, and suspension of sentence; limitations. Limits the amount of active incarceration a court can impose as a result of a revocation hearing for a probation violation. The bill provides that if the court finds the basis of a violation of the terms and conditions of a suspended sentence or probation is that the defendant was convicted of a criminal offense or violated another condition other than a technical violation, the court may pronounce whatever sentence might have been originally imposed. The bill defines "technical violation" and provides specific limitations on the sentence a court may impose depending on whether the violation is a first, second, or third or subsequent technical violation. The bill also provides that a court may fix the period of probation for up to the statutory maximum period for which the defendant might originally have been sentenced to be imprisoned and any period of supervised probation shall not exceed five years from the release of the defendant from any active period of incarceration. The bill also provides that a court must measure any period of suspension of sentence from the date of entry of the original sentencing order.
Identification privilege cards; fee; confidentiality; penalties. Authorizes the Department of Motor Vehicles to issue identification privilege cards to applicants who hold a citizenship or legal presence status that is eligible for a special identification card or a limited-duration special identification card and have reported income from Virginia sources or been claimed as a dependent on an individual tax return filed with the Commonwealth in the preceding 12 months. The bill provides that identification privilege cards shall be treated as special identification cards unless otherwise provided in the Code of Virginia. The bill limits the release of certain information stored by the Department. The bill has a delayed effective date of January 1, 2022.
Electric vehicle rebate program; creation andfunding; report. Creates a rebate program for the purchase or lease of new and used electric vehicles, to be administered by the Department of Mines, Minerals and Energy. A purchaser or lesseeof an electric vehicle would receive a $2,500 rebate at the timeof purchase, and a purchaser or lessee with an annual household incomethat does not exceed 300 percent of the federal poverty level wouldbe entitled to an additional $2,000 rebate. The motor vehicle dealerwhere the vehicle is purchased or leased would receive a refund forthe amount of the rebate and a $50 incentive payment for each rebateprocessed. Funds would be allocated from the revenues generated bythe sunset of the Virginia Coal Employment and Production IncentiveTax Credit and the Coalfield employment enhancement tax credit andprohibit the allocation of new credits on and after January 1, 2021.The bill also establishes an Electric Vehicle Rebate Advisory Councilto oversee the Electric Vehicle Rebate Program and to make recommendationsregarding its implementation. The Director of the Department of Mines,Minerals and Energy is required to report annually to the Governorand the General Assembly regarding the Program. The Program will expire on September 1, 2026.
Virginia Human Rights Act; definition of employer;person employing one or more domestic workers. Expands the definitionof "employer" for all purposes of the Virginia Human Rights Act toinclude a person employing one or more domestic workers, as definedin the bill.
