Virginia Human Rights Act; nondiscriminationin employment; sexual harassment and workplace harassment. Clarifies,by defining sexual harassment and workplace harassment, what constitutesan unlawful employment practice if engaged in by an employer. Thebill also provides (i) a nonexhaustive list of factors to considerwhen determining whether certain conduct constitutes workplace harassment,(ii) that a person claiming to be aggrieved by an unlawful discriminatorypractice may file a written complaint with the Division of HumanRights within two years after the occurrence of the alleged unlawfuldiscriminatory practice, and (iii) that an aggrieved person who hasbeen provided a notice of his right to file a civil action for suchgrievance may do so within one year of receiving such notice andmay be awarded reasonable attorney fees, including costs and reasonablelitigation expenses if the court or jury finds in his favor. Thebill also amends the definition of "employer" to mean a person employingfive or more employees, instead of 15 or more employees under currentlaw, for each working day in each of 20 or more calendar weeks inthe current or preceding calendar year, and any agent of such a person.
Nursing home staffing and care standards; study.Requires regulations establishing the staffing and care standardsin nursing homes to require a minimum number of hours of directcare services to each resident per 24-hour period, which minimumincreases in specified phases from 3.5 hours to 4.1 hours. The billalso directs the Joint Commission on Health Care to study issues related to establishment of a minimum number of hours of direct careservices for nursing homes as part of its study of the nursing facilityworkforce authorized by the Commission on December 15, 2020, andto report its findings by December 1, 2021. The regulatory provisionsof the bill have a delayed effective date of July 1, 2022.
Teacher compensation; at or above national average.Requires that public school teachers be compensated at a rate thatis at or above the national average. Under current law, compensationat such rate is aspirational. The bill requires state funding tobe provided pursuant to the general appropriation act in a sum sufficientto fund a 4.5 percent annual increase for public school teacher salaries,effective from the 2022-23 school year through the 2026-27 schoolyear. The bill has a delayed effective date of July 1, 2022.
