Robbery; penalty. Defines "robbery" andcreates degrees of punishment corresponding to the severity of arobbery offense. Any person who commits a robbery by causing seriousbodily injury is guilty of robbery in the first degree, which ispunishable by confinement in a state correctional facility for amaximum term of life. Any person who commits robbery by displayinga firearm in a threatening manner is guilty of robbery in the second degree, which is punishable by confinement in a state correctionalfacility for a maximum term of 20 years. Any person who commits robberyby using physical force not resulting in serious bodily injury, orby displaying a deadly weapon other than a firearm in a threateningmanner, is guilty of robbery in the third degree, which is punishableas a Class 5 felony. Any person who commits robbery by using threator intimidation not involving a deadly weapon is guilty of robberyin the fourth degree, which is punishable as a Class 6 felony. Undercurrent law, any robbery is punishable by confinement in a statecorrectional facility for life or any term not less than five years.

Health insurance; coverage for mammograms.Requires health insurers, on and after January 1, 2021, to providecoverage for low-dose screening mammograms at rates that are more frequent than is currently required if the covered individual hasa family history of breast cancer. If the individual has a familyhistory of breast cancer, the bill requires coverage for annual mammogramsfrom age 30 through 49 and biannual mammograms starting at age 50.However, the age at which such coverage of annual mammograms startsshall be younger than 30 if the covered individual's mother was diagnosedwith breast cancer at an age earlier than 40, in which event coveragestarts during the year that the individual attains an age that is10 years younger than the age of the individual's mother at thetime of her diagnosis.
Guardianship and conservatorship petitions; identifying characteristics of the respondent. Adds certain identifying characteristics of the respondent to the content requirements of a petition for the appointment of a guardian, a conservator, or both if such petition contains a statement that the respondent is a threat of harm to himself or others. The bill further requires that such identifying characteristics be included in the information sent to the Criminal Records Exchange by the clerk if such a statement is included in the petition.
Expungement of police and court records.Provides that a court that enters a nolle prosequi for a criminalcharge or dismisses such charge for any reason may, upon motion ofthe person charged, enter an order requiring the expungement of thepolice and court records relating to the charge.
Reproductive health services. Requires healthbenefit plans to cover the costs of specified health care services,drugs, devices, products, and procedures related to reproductivehealth. The health benefit plan requirements become effective whena plan is delivered, issued for delivery, reissued, or extended inthe Commonwealth on and after January 1, 2021, or at any time thereafterwhen any term of the health benefit plan is changed or any premiumadjustment is made. The measure also requires the Board of MedicalAssistance Services to include in the state plan for medical assistanceservices a provision for the payment of the costs of a reproductive health care program providing reimbursement for medically necessary reproductive health care services, drugs, devices, products, andprocedures for eligible individuals.
Health insurance; coverage for prosthetic devices. Requires health insurers, corporations providing health care coverage subscription contracts, health maintenance organizations, and the Commonwealth's Medicaid program to provide coverage for prostheticdevices, including myoelectric, biomechanical, or microprocessor-controlledprosthetic devices that have a Medicare code. The measure repealsthe existing requirement that coverage for prosthetic devices beoffered and made available. The measure has a delayed effective dateof January 1, 2021.
Reading diagnostic tests; intervention. Requireseach student in kindergarten and grade one to participate in readingdiagnostic tests that include a rapid automatized naming test andone or more rapid alternating stimulus tests as follows: (i) forstudents in kindergarten, a rapid automatized naming test and a rapidalternating stimulus test that each include colors and objects and(ii) for students in grade one, a rapid automatized naming test andtwo rapid alternating stimulus tests that each include colors, objects,letters, and numbers. The bill requires any student who enrolls ina public elementary school in the Commonwealth for the first timein grade two or grade three to participate in the reading diagnostic tests required for students in grade one. The bill specifies thatsuch diagnostic tests shall consist of the RAN/RAS tests developedand published by Maryanne Wolf and Martha Bridge Denckla or a substantiallysimilar reading diagnostic tool that is evidence-based, normed, andapproved by the Department of Education. The bill requires, beginningJuly 1, 2021, each local school division to provide evidence-based,structured literacy instruction to students in kindergarten throughgrade three who fall below the benchmark on any such reading diagnostictest and requires that such structured literacy instruction be overseenand monitored by the local school division's advisor on dyslexiaand related disorders, when applicable.
Discretionary sentencing guidelines worksheets;use by juries. Requires that the jury be given the applicablediscretionary sentencing guidelines worksheets during a sentencing proceeding and that the court instruct the jury that the sentencingguidelines worksheets are discretionary and not binding on the jury.The bill requires sentencing guidelines worksheets to be kept confidentialby the jurors and filed under seal by the court.
Expungement of police and court records; misdemeanorand nonviolent felony convictions. Allows a person convictedof certain misdemeanors or nonviolent felonies to file a petitionrequesting expungement of the police and court records relating tothe conviction if such person (i) has been free from any term of incarceration,probation, or postrelease supervision imposed as a result of suchconviction for (a) at least three years for a misdemeanor convictionand (b) at least five years for a felony conviction; (ii) has no outstanding costs, fines, or restitution; and (iii) has no pending criminal proceeding.
Possession of marijuana. Allows for possession of small amounts of marijuana for personal use.
