This resolution designates the week of May 9-May 15, 2021, as National Police Week.
Limiting CDC to Disease Control Act This bill modifies and limits the authority of the Department of Health and Human Services (HHS) to issue regulations to control communicable diseases. Current law authorizes HHS to make and enforce regulations to prevent the introduction or spread of communicable diseases. In particular, current law provides that HHS may make and enforce regulations addressing (1) isolation and quarantine of infected individuals (subject to certain restrictions); and (2) inspection, fumigation, disinfection, sanitation, pest extermination, destruction of infected animals or articles, and other measures that the department determines may be necessary. HHS has delegated this authority to the Centers for Disease Control and Prevention (CDC). This bill eliminates the authority of the CDC to make and enforce regulations that provide for other measures it determines may be necessary to prevent the spread of communicable diseases, thereby limiting the scope of its regulations to the other specific purposes set out in current law.
Temporary Family Visitation Act This bill establishes a new nonimmigrant visa classification for an alien temporarily entering the United States to visit a relative who is a U.S. citizen or lawful permanent resident. The maximum period of stay for a family visitor visa shall be 90 days. An alien seeking such a visa must have health insurance for the duration of the stay. An alien who holds such a visa may not change to another nonimmigrant visa classification except in certain limited instances. If an alien has been approved for a family-based immigrant visa and is waiting for one to become available, the alien may obtain a family visitor visa if the alien meets the eligibility requirements.
This resolution designates the week beginning November 8, 2021, as National Pregnancy Center Week.
Legislative Performance Review Act of 2021 This bill limits the duration of authorizations of appropriations, requires programs with expired authorizations to be terminated, and establishes reporting requirements. The bill prohibits Congress from considering legislation that (1) authorizes appropriations for more than four years, or (2) authorizes the enactment of an unlimited amount of appropriations for any purpose. If Congress determines that an authorization for more than four years is necessary to accomplish the purposes of an authorization, it may waive the time limit by considering a waiver resolution using expedited legislative procedures. Congressional committees that report legislation authorizing appropriations must include in committee reports (1) an analysis, appraisal, and evaluation of existing programs for which appropriations are authorized; and (2) specified details regarding the purpose and need for new programs for which appropriations are authorized. Federal agencies must implement a plan to phase out certain programs with expired authorizations. The bill establishes points of order against legislation that provides appropriations that are either unauthorized or are pursuant to authorizations that violate the time limits established by this bill.
Long-Term Care Pharmacy Definition Act of 2021 This bill establishes a statutory definition for long-term care pharmacy under the Medicare prescription drug benefit. Currently, there is no statutory definition. Regulations from the Centers for Medicare & Medicaid Services (CMS) define a long-term care pharmacy as a pharmacy that is owned by or under contract with a long-term care facility to provide prescription drugs to the facility's residents. Additional requirements are set out in CMS guidance relating to the Medicare prescription drug benefit; pharmacies are also subject to regulations and guidance from other agencies (e.g., packaging requirements from the Food and Drug Administration). The bill defines a long-term care pharmacy as a state-licensed pharmacy that is able to provide enhanced pharmacy and clinical services to individuals who have certain comorbid and medically complex chronic conditions and who reside in skilled nursing facilities, nursing facilities, or any other applicable setting (as determined by the CMS). The term enhanced pharmacy and clinical services includes medication dispensed in special packaging, drug utilization review, and 24-7 availability of medication delivery and on-call pharmacists.
This resolution congratulates the University of Kentucky Wildcats for winning the 2020 National Collegiate Athletic Association Division I Women's Volleyball Championship and completing a successful 2020-2021 season.
Military Justice Improvement and Increasing Prevention Act of 2021 This bill modifies the process and policy related to the disposition of charges and convening of courts-martial for certain sexual assault cases and other specified offenses under the Uniform Code of Military Justice (UCMJ). Among other elements, the bill provides that the determinations on the preferral, disposition, and referral of charges for specified offenses under the UCMJ must be made by a commissioned officer of the Armed Forces who is designated as a court-martial convening authority (in grade O-6 or higher) and who is available for detail as trial counsel, has significant trial experience, and is outside the chain of command of the member subject to the charges.
Marijuana Data Collection Act This bill requires the Department of Health and Human Services, in coordination with the Department of Justice, the Department of Labor, and relevant state agencies, to enter into an arrangement with the National Academy of Sciences in order to study the effects of marijuana legalization in states for medicinal or non-medicinal use.
Woman's Right To Know Act This bill specifies requirements for informed consent that health care providers must obtain before performing an abortion procedure. Providers must present a woman seeking an abortion with an authorization form at least 24 hours before performing the procedure. The form must (1) include specified information concerning gestational age, associated developmental characteristics, and medical risks; (2) disclose penalties that providers may face for failing to obtain the requisite informed consent; and (3) include an affirmation that the individual signing the form understands the information. The form must be signed and witnessed in person and retained in the medical file. Providers do not have to obtain such consent if, in reasonable medical judgment, obtaining it would pose a greater risk of death or substantial physical impairment of a major bodily function, excluding psychological or emotional conditions, of the pregnant woman. The bill also establishes civil penalties for providers who do not comply with these requirements.
