Continuing care providers; quarterly meeting requirements. Amends the quarterly meeting requirements for continuing care facilities to provide that at least two of such meetings per year shall be open to all residents and that certain individuals shall participate in at least two of such meetings per year. The bill also requires, if requested by the resident council or a majority of the independent living residents of a continuing care facility, the provider to include as a participant in the meetings of its board of directors or other governing body a resident representative elected by a majority of such residents, who shall participate in a non-voting, advisory capacity. This bill is identical to SB 358.

Department of Health; Department of Social Services; publicly accessible nursing home information portal; publicly accessible assisted living facility information portal; reporting of incidents involving emergency medical services. Directs the Department of Health to establish a nursing home information portal and the Department of Social Services to establish an assisted living facility information portal to consolidate publicly available information on nursing homes and assisted living facilities, respectively. The bill requires operators of nursing homes and assisted living facilities to submit a quarterly report to the Department of Health or the Department of Social Services, respectively, with information on incidents involving emergency medical services.

Inspection of certified nursing facilities; compliance with federal reporting requirements; civil penalty. Directs the Department of Health to include validation of compliance with federal reporting requirements in its inspection process for certified nursing facilities. The bill requires certified nursing facilities to submit a quarterly report detailing (i) all self-reported incidents and compliance issues submitted to the Centers for Medicare and Medicaid Services during the preceding quarter; (ii) any corrective actions taken in response to self-reported incidents; and (iii) updates on ongoing investigations related to reported incidents. The Department may impose a penalty on a certified nursing facility that fails to comply with the reporting requirements imposed by the bill, which may include a civil penalty not to exceed $1,000, increased frequency of inspections, and suspension or revocation of the certified nursing facility's license.

Nursing homes and certified nursing facilities; required liability insurance coverage. Provides that the regulations of the Board of Health shall require purchasers of licensed nursing homes or certified nursing facilities with claims-made policies of liability insurance coverage to purchase an extended reporting endorsement of two years after the date of sale or to purchase liability insurance coverage with dates that begin two years prior to the date the existing owner's policies end.

Nursing homes; periodic medical visits and resident assessments. Requires all nursing homes to notify the resident of a nursing home, the resident's family, and the Department of Health if a federally required physician visit does not take place. The bill also requires each nursing home to conduct a comprehensive assessment on an annual basis to determine each resident's needs and describe each resident's capability to perform daily life functions. Such assessments must be reviewed at least once every 92 days, and more frequently in the event of a significant change in the resident's physical or mental condition.

Joint Commission on Health Care; evaluation of workforce in Virginia nursing facilities. Directs the Joint Commission on Health Care to evaluate the workforce in Virginia's nursing facilities and to develop recommendations on several topics outlined in the bill. The bill requires the Joint Commission to report its findings to the Governor and the Chairs of the House Committees on Health and Human Services and Appropriations and the Senate Committees on Education and Health and Finance and Appropriations by December 1, 2026.

Requires all nursing homes to notify the resident of a nursing home, the resident's family, and the Department of Health if a federally required physician visit does not take place. The bill also requires each nursing home to conduct a comprehensive assessment on an annual basis to determine each resident's needs and describe each resident's capability to perform daily life functions. Such assessments must be reviewed at least once every 92 days, and more frequently in the event of a significant change in the resident's physical or mental condition. The bill directs the Department of Health and State Health Commissioner to take steps to improve care quality, protect residents, and strengthen oversight and accountability of nursing homes in the Commonwealth. The bill directs the Department to enhance recruitment efforts and expand workforce capacity in the Office of Licensure and Certification, accelerate training and onboarding initiatives, and explore measures to reduce administrative burdens. The bill requires the Commissioner to submit an annual report with recommendations for continuing improvement of nursing home quality and oversight. This bill incorporates SB 555.

Palliative Care Information and Education Program; Palliative Care and Quality of Life Advisory Council established. Directs the Board of Health to include in its regulations a requirement that every hospital, nursing home, and certified nursing facility licensed by the Board (i) establish a system for identifying patients or residents who may benefit from palliative care and (ii) provide information about and facilitate access to appropriate palliative care services for patients or residents experiencing illness, injuries, or conditions that substantially affect quality of life for more than a short period of time. The bill also directs the Department of Health to establish a palliative care consumer and professional information and education program to maximize the effectiveness of palliative care initiatives in the Commonwealth by (a) ensuring that comprehensive and accurate information and education about palliative care is available to the public, health care providers, and health care facilities and (b) implementing such other initiatives related to education about palliative care and the delivery of palliative care services as may be necessary to educate health care professionals and the public about palliative care. The bill further establishes the Palliative Care and Quality of Life Advisory Council to advise the Department on matters related to the establishment, operation, maintenance, and outcomes evaluations of such initiatives. The bill directs the Palliative Care and Quality of Life Advisory Council to study the possibility of establishing a Medicaid benefit for palliative care and the need for a licensure scheme for palliative care providers. The bill further directs the Board of Health to develop a statewide advanced care planning campaign to increase public awareness of available palliative care options.

Nursing homes and assisted living facilities; licensure; automated external defibrillators. Requires nursing homes and assisted living facilities to have and maintain an automated external defibrillator and have staff trained to use such automated external defibrillator.
