Personal property tax; classification; sunsetdate. Removes the sunset date from the provision of law that authorizes localities to classify most motor vehicles as a class ofproperty subject to a different rate of tax or rate of assessmentfrom the rate applicable to the general class of tangible personalproperty. Under current law, such classification would expire beginningwith taxable years beginning on or after January 1, 2025.
Discovery; electronic means. Requires allattorneys for the Commonwealth to provide discovery materials forall courts to counsel of record for the accused by electronic meansunless such material is prohibited from being distributed by law.The bill directs the Supreme Court of Virginia to promulgate rulesto implement this provision by January 1, 2025.
Property rights in parking areas owned or controlledby the Commonwealth; firearms and ammunition. Provides that withcertain exceptions the Commonwealth shall not adopt or enforce anystatute or regulation that prevents an employee, visitor, or contractorfrom storing a lawfully possessed firearm and ammunition in a locked private motor vehicle parked at any parking area owned or controlledby the Commonwealth. The bill also provides that any previously enactedstatutes, promulgated regulations, policies, or rules that are inconsistentwith the provisions of the bill are null and void.
Campaign finance; prohibited contributionsto candidates. Prohibits candidates, campaign committees, and political committees from soliciting or accepting contributions fromany public utility, as defined in the bill, and prohibits any publicutility or any political committee established by such public utilityfrom making any such contribution.
Sales tax; school construction. Adds theCity of Portsmouth to the list of localities that, under currentlaw, are authorized to impose an extra one percent local sales taxto provide revenue for constructing or renovating schools.
Absentee voting; absentee voting in person;available beginning 14 days prior to election. Limits the availabilityof absentee voting in person to 14 days before the election. Undercurrent law, absentee voting in person is available beginning 45 days prior to the election.
Loan repayment programs; mental health professionals. Creates a loan repayment program for persons who have worked as mentalhealth professionals in the Commonwealth for at least five years.
Portable benefit accounts; tax credit.Authorizes a Virginia resident who has worked as an independent contractorto establish a portable benefit account. Under the bill, a portable benefit account offered through and administered by a bank, creditunion, or other depository institution and distributions from theaccount may be used for the payment of various health-related costs.The bill establishes a nonrefundable tax credit for taxable years2024 through 2028 for individuals who contribute to a portable benefitaccount.
Law-enforcement officers; protected personalinformation. Provides that any law-enforcement officer who providesinformation relative to a criminal investigation or in proceedingspreliminary to a criminal prosecution may refuse, unless orderedby a court, to disclose his residence address, home telephone number,or any personal information concerning his family. The bill alsoprovides that any law-enforcement officer who testifies as a witnessin a criminal case may refuse to disclose personal information concerninghis family unless it is determined by the court that such evidenceis relevant to the case.
Department of Criminal Justice Services; certificationand regulation of charitable bail organizations. Provides forcertification and regulation by the Department of Criminal JusticeServices of charitable bail organizations, defined in the bill asany entity or nonprofit organization that exists for the purposeof providing or posting bond for another person and does not includea person that pays bail for (i) three or fewer defendants in any180-day period or (ii) a defendant's family or household member.
Consumer Data Protection Act; social media;parental consent. Requires social media platforms, defined inthe bill, that are subject to the provisions of the Children's OnlinePrivacy Protection Act to obtain verifiable parental consent priorto permitting any minor to create an account with such social mediaplatform and, with such account, use the social media platform. Thebill requires such social media platforms to give the parent or guardianthe option to consent to the collection and use of the minor's personaldata without consenting to the disclosure of such minor's personaldata to third parties.
Identity of persons communicating anonymouslyover the Internet; procedure governing certain subpoenas in civilproceedings; social media companies and platforms. Applies theprocedures governing certain subpoenas in civil proceedings, currentlyapplicable to Internet service providers, to social media companiesand platforms.
