Admission of evidence; evidentiary hearing;excluded persons. Exempts those persons whose presence, in thejudgment of the court, would be supportive of the complaining witnessor the accused and would not impair the conduct of a fair hearingfrom being excluded from evidentiary hearings for certain prosecutions.
Therapeutically equivalent drug products; provisionsfor return of outdated drugs. Requires drug manufacturers toimplement provisions for the return of drugs past their expiration date by pharmacies in order for their products to be eligible for dispensing as a therapeutically equivalent drug.
Virginia income tax subtractions; disabilityincome. Allows an individual who claims an income tax subtractionfor disability income to also claim an income tax deduction for taxpayersage 65 and older.
School crossing zones. Expands the definitionof "school crossing zone" to include areas surrounding schools wherethe presence of students reasonably requires a special warning tomotorists and provides that the term "school" includes public institutionsof higher education and nonprofit private institutions of highereducation. Currently, the definition of "school crossing zone" includesonly areas surrounding schools where the presence of children requiressuch warning. Existing provisions of law allowing photo speed monitoringdevices to be installed in school crossing zones will apply to anylocation that meets the expanded definition.
Zoning ordinances; adequate public facilities.Allows a locality to determine the timing of development by consideringthe adequacy of public facilities when making zoning decisions. Thebill provides that a locality that makes a determination of inadequatefacilities may reject or defer a rezoning application based solelyon that determination.
Sex offenses prohibiting proximity to children;state parks; penalty. Provides that every adult who is convictedof an offense prohibiting proximity to children, when the offenseoccurred on or after July 1, 2024, shall as part of his sentencebe forever prohibited from going, for the purpose of having any contactwhatsoever with children who are not in his custody, within 100 feetof the premises of any area of a state park where he knows or hasreason to know that children are present. A violation is a Class 6 felony.
Sex offenses prohibiting working on school property; penalty. Adds certain offenses involving children, includingkidnapping, trafficking, sex crimes, and prostitution and commercialsex crimes, to the list of offenses that would prohibit an adult ifconvicted of such offense from working or engaging in any volunteeractivity on property he knows or has reason to know is a public orprivate elementary or secondary school or child day center. A violationof any such offense is a Class 6 felony.
Marijuana; criminal penalties. Modifiesseveral criminal penalties related to marijuana, imposes limits ondissemination of criminal history record information related to certainmarijuana offenses, and provides a petition process for any personwho has been sentenced to jail or to the custody of the Departmentof Corrections for a marijuana offense to seek a resentencing hearing.The bill has a delayed effective date of July 1, 2025.
Disposal of unclaimed property in possessionof sheriff or police; notice of public display and sale. Allowsa law-enforcement agency to publish the required notice that therewill be a public display and sale of certain unclaimed personal propertythat has been in the possession of such law-enforcement agency andremained unclaimed for more than 60 days on the law-enforcement agency'sofficial website or any related social media platforms once a weekfor two successive weeks. Under current law, such notice may onlybe published in a newspaper of general circulation in the locality.
Commercial entity offering social media accounts; restricted hours for minors; civil liability. Provides that nocommercial entity that offers social media accounts, as defined inthe bill, shall knowingly or intentionally allow a minor to accesshis social media account during the hours of 12:00 a.m. to 6:00 a.m.unless the minor's parent, guardian, or legal custodian has providedpermission for the minor to use such social media account duringthese hours. The bill provides that any commercial entity that violatesthese provisions shall be subject to civil liability for damages resulting from the interference with a minor's sleep cycle or mentalhealth by allowing such minor to access to his social media accountduring the hours of 12:00 a.m. to 6:00 a.m. and reasonable attorneyfees and costs.
Electric utilities; temporary power purchaseagreements. Provides that if the State Corporation Commissiondetermines that, due to transmission constraints, a public utilityis not able to furnish electric service sufficient to meet the currentand reasonably anticipated requirements of a customer located insuch public utility's service territory, such customer shall be permittedto enter into a temporary power purchase agreement with a third partythat shall be authorized to own and operate a facility generatingzero-carbon electricity located on such customer's site to servepart or all of such customer's electric service requirements. Underthe bill, such authorization shall extend for at least six years.
Board of Medicine; breast implant patient decision checklist required. Directs the Board of Medicine to developa patient decision checklist for procedures involving breast implantsthat informs patients of the potential risks of breast implants. The bill requires physicians to obtain an executed breast implantpatient decision checklist from the patient before conducting anyprocedure that involves breast implants.
