This resolution recognizes the forthcoming centennial of the Tulsa Race Massacre of 1921. The resolution acknowledges the historical significance of this event as one of the largest single instances of state-sanctioned violence against Black people in American history; honors the lives and legacies of the estimated 300 Black individuals who were killed during the massacre and the nearly 9,000 who were left homeless and penniless; condemns efforts to cover up the truth and shield the white community, especially government officials, from accountability; condemns the continued legacy of racism and white supremacy against Black people in the United States, particularly in the form of police brutality; encourages education about the massacre, the history of white supremacy that fueled the massacre, and subsequent attempts to deny or cover up the massacre, in all elementary and secondary education settings and in institutions of higher education; and recognizes the commitment of Congress to acknowledge and learn from the history of racism and racial violence to reverse the legacy of white supremacy and fight for racial justice.

Institutional Grants for New Infrastructure, Technology, and Education for HBCU Excellence Act or the IGNITE HBCU Excellence Act This bill establishes a grant program to support long-term improvements of historically Black colleges and universities (HBCUs) and graduate programs at HBCUs. Specifically, the bill requires the Department of Education (ED) to award grants to HBCUs to improve campus facilities. A recipient must use grant funds for certain activities, such as constructing or renovating facilities, carrying out major repairs, and strengthening the safety and security of a campus. Any new construction, modernization, or renovation projects must meet building code and energy and water conservation requirements. Further, HBCUs must seek to procure contracts from certain small businesses, including those owned and controlled by veterans and service-disabled veterans. The bill prohibits the use of grant funds for specified activities, including for the payment of routine and predictable maintenance costs, minor repairs, and utility bills. The Government Accountability Office must study the implementation of the grant program. The bill also requires ED to repay the outstanding balance of principal, interest, fees, and costs and any related reimbursements for certain capital financing loans.

Transportation Equity Act This bill directs the Department of Transportation (DOT) to reestablish the Transportation Equity Committee. The committee must provide independent advice and recommendations to DOT on transportation equity issues. The committee must also evaluate the work of DOT in connecting people to economic and related forms of opportunity and carrying out its strategic, research, technological, regulatory, community engagement, and economic policy activities related to transportation and opportunity. In addition, DOT must appoint a full-time federal employee to serve as coordinator and act as the designated federal officer for the committee.

This bill waives certain requirements for U.S. nationals applying for citizenship. Currently, individuals born in an outlying possession (i.e., American Samoa or Swains Island) are U.S. nationals but do not automatically acquire citizenship through birth in an outlying possession. Under this bill, a U.S. national who otherwise qualifies may become a citizen upon establishing residence and physical presence in a U.S. outlying possession. Currently, U.S. nationals must become a resident of a state to qualify for naturalization. The bill also waives certain naturalization requirements, including those related to English language proficiency and participation in a public ceremony, for individuals who have continuously resided in an outlying possession or state from birth to the approval of a naturalization application. Furthermore, upon meeting other requirements, this bill allows a child born abroad of a U.S. citizen parent to acquire citizenship by establishing presence and residency in an outlying possession, where currently such a child must be lawfully present in the United States to acquire citizenship through this method.

Non-Opioids Prevent Addiction In the Nation Act or the NOPAIN Act This bill temporarily establishes separate payments for certain non-opioid treatments under the Medicare prospective payment system for hospital outpatient department services and the payment system for ambulatory surgical center services. The bill applies to pain management treatments that are able to replace or reduce opioid consumption, as shown through clinical trials or data.

Metastatic Breast Cancer Access to Care Act This bill expedites payment of Social Security Disability Insurance (SSDI) benefits and eligibility for Medicare coverage for those with metastatic breast cancer (i.e., breast cancer that has spread to other sites in the body). Specifically, the bill eliminates the 5-month waiting period for SSDI benefits and the subsequent 24-month waiting period for Medicare coverage for individuals with metastatic breast cancer. Under current law, individuals generally must wait five months after the onset of disability to begin receiving SSDI benefits and an additional 24 months to become eligible for Medicare.

This bill provides that, in determining the meaning of any federal statute or any ruling, regulation, or interpretation of the various U.S. administrative bureaus and agencies, the term  state shall include any U.S. territory, unless the statute, rule, regulation, or interpretation explicitly excludes the territories from the definition of the term or otherwise precludes their inclusion.

Justice for Black Farmers Act of 2021 This bill directs the Department of Agriculture (USDA) to provide a variety of assistance to address historical discrimination and disparities in the agricultural sector. For example, the bill establishes an equity commission in USDA to examine discrimination by the agency against Black farmers and ranchers and recommend actions to end the systematic disparities in the treatment of Black farmers and ranchers. USDA must also establish a Farm Conservation Corps to provide young adults who are from socially disadvantaged groups with the skills necessary to pursue careers in farming and ranching. The bill provides funding for historically Black colleges and universities to commence and expand courses of study that are focused on careers in agriculture or related disciplines. The bill also increases the authorization of appropriations for a program to resolve issues relating to ownership and succession on farmland. Additionally, it expands credit assistance for socially disadvantaged farmers and ranchers. Further, the bill (1) establishes that a minimum of 50% of a covered packer's (not including a packer that owns only one livestock processing plant) daily volume of livestock slaughter must be purchased through spot market sales from nonaffiliated producers; (2) increases funding for the Local Agriculture Market Program; and (3) gives priority to socially disadvantaged farmers and ranchers for conservation technical assistance, the Conservation Stewardship Program, and the Rural Energy for America Program.

U.S. Citizenship Act This bill establishes a path to citizenship for certain undocumented individuals. The bill also replaces the term alien with noncitizen in the immigration statutes and addresses other related issues. Specifically, the bill establishes a new status of lawful prospective immigrant . This status shall be available to an applying noncitizen who meets certain requirements, including being continually present in the United States from January 1, 2021, and passing background checks. After at least five years with this status, an eligible noncitizen may apply for and receive permanent resident status. The bill also provides permanent resident status to certain applying noncitizens, specifically for eligible noncitizens who (1) entered the United States as a minor, (2) were eligible for temporary protected status or deferred enforced departure on January 1, 2017, or (3) worked a certain amount of agricultural labor in the five years prior to applying. Among other things, the bill also redefines for immigration purposes the term conviction to exclude convictions that have been expunged or vacated, requires the Department of State to implement a strategy to advance reforms in Central America and address key factors contributing to migration from the region to the United States, requires the State Department to establish refugee processing centers in Central America, requires Customs and Border Patrol sectors and stations to have a certain number of employees with certain qualifications such as paramedic training, generally prohibits religious discrimination in granting or denying immigration benefits, and establishes grant programs for providing training and services to immigrants.

Keeping Guns from High-Risk Individuals Act This bill expands the categories of persons who are prohibited from shipping, transporting, receiving, or possessing firearms or ammunition. Specifically, it adds the following new categories of prohibited persons: persons convicted of a crime of violence in the most recent 10-year period; persons under age 25 who have been adjudicated as having committed an offense that would have been a crime of violence if committed by an adult; persons convicted, during a consecutive 3-year period in the most recent 10-year period, of two separate offenses involving drug or alcohol possession or distribution; and persons convicted of stalking.
