A bill to reaffirm actions taken by the Secretary of the Interior for the benefit of Indian Tribes, and for other purposes.

This bill authorizes the Department of the Interior to take land into trust for all federally recognized Indian tribes. Specifically, the bill applies the Indian Reorganization Act to all federally recognized Indian tribes, regardless of when a tribe became recognized. The amendments made by this bill are retroactively effective as if included in the Indian Reorganization Act. This effectively overrules the Supreme Court's decision in Carcieri v. Salazar, which held that Interior could not take land into trust for a specified tribe because that tribe had not been under federal jurisdiction when the Indian Reorganization Act was enacted in 1934.

Ensuring the Best Schools for Veterans Act of 2022

Ensuring the Best Schools for Veterans Act of 2022 This act makes adjustments to the process by which the Department of Veterans Affairs (VA) evaluates programs of education for violations of the 85/15 Rule. The rule generally prohibits the VA from approving the enrollment of a veteran in any course at an educational institution where more than 85% of the students are having all or part of their tuition or other charges paid by the institution or the VA. The act adds an exception for tuition or charges paid under a payment plan at an educational institution with a history of offering payment plans that are completed within 180 days after the end of the applicable term, quarter, or semester. The act also requires the VA to establish a process by which an educational institution may request a review of a determination that the institution has more than 85% of enrolled students that have all or part of their tuition or other charges paid by the institution or the VA. The act adjusts the existing 35% exemption by exempting courses from the 85/15 Rule if the majority of courses at the institution are approved by the state approving agency, and the total number of veterans, reservists, or eligible beneficiaries who are enrolled at the institution equals 35% or less of the total student enrollment at the institution. Additionally, the 85/15 Rule does not apply with respect to the enrollment of a veteran in a program of education with fewer than 10 students who are having all or part of their tuition or other charges paid to or for them by the educational institution or the VA.

A resolution honoring and celebrating the life and legacy of Representative Jackie Walorski.

This resolution expresses that the Senate has heard the announcement of the death of the Honorable Jacqueline R. Walorski, Congresswoman for the Second Congressional District of Indiana. The resolution also honors Representative Walorski for her service to Indiana and the United States. The resolution expresses that when the Senate adjourns today, it stands adjourned as a further mark of respect to the memory of Representative Walorski.

Afghan Adjustment Act

Afghan Adjustment Act This bill expands eligibility for special immigrant visas to certain Afghan nationals (and accompanying spouse and children) and addresses related issues. The Department of Homeland Security may provide such visas to Afghan nationals who provided qualifying service as a member of the Afghan Air Force or other specified entities and meet eligibility requirements, such as passing a background check. Currently, special immigrant visas for Afghan nationals are generally only available to those who were employed by or on behalf of the U.S. government in Afghanistan. Such visas shall also be available to an Afghan national who is a qualifying relative of a veteran or member of the U.S. Armed Forces. The bill also modifies procedures for providing lawful permanent resident status to certain classes of Afghan nationals, such as by (1) providing a streamlined process with specified vetting requirements for certain individuals, including those who provided support to the U.S. government in Afghanistan; and (2) preserving the eligibility of certain battered spouses whose eligibility for such status stemmed from a marriage that has terminated. Furthermore, the Department of State (1) must respond to inquiries from Members of Congress about specific applications from Afghan nationals seeking special immigrant or refugee status; and (2) establish an office in Afghanistan to perform certain tasks, such as issuing visas, if no U.S. embassies are operational in Afghanistan. The President must establish a task force to develop and implement a strategy to assist Afghan nationals who qualify for admission to the United States.

Recovering America’s Wildlife Act of 2022

Recovering America’s Wildlife Act of 2022 This bill provides financial and technical assistance to states, territories, and the District of Columbia for the purposes of (1) recovering species listed as a threatened or endangered species under the Endangered Species Act or under state law, or (2) avoiding the need to list species under such laws. For example, the bill establishes the Endangered Species Recovery and Habitat Conservation Legacy Fund. A portion of the fund must be used to establish an Endangered Species Recovery Grant Program. It also provides funding for (1) the conservation or restoration of wildlife and plant species of greatest conservation need; (2) the wildlife conservation strategies of states, territories, or the District of Columbia; and (3) wildlife conservation education and recreation projects. The Department of the Interior must use a portion of the funding for a grant program. The grants must be used for innovative recovery efforts for species of greatest conservation need, species listed as endangered or threatened species, or the habitats of such species. In addition, the bill requires certain revenues generated from fees and penalties for violations of environmental requirements to be used as a source for the funding.

Southwestern Power Administration Fund Establishment Act

Southwestern Power Administration Fund Establishment Act This bill establishes a fund that the Southwestern Power Administration may use for the operation and maintenance of power transmission facilities and other related expenses. The bill also transfers amounts into the fund from specified accounts.

Combating Violent and Dangerous Crime Act This bill revises various statutes with respect to violent crimes and establishes new criminal offenses. For example, the bill (1) increases the statutory maximum penalty for carjacking, and (2) establishes enhanced criminal penalties for certain federal drug offenses involving the manufacture or distribution of candy-flavored controlled substances or similar products for minors.
