Rep. Tom Malinowski

This resolution expresses support for (1) equal rights and protections for all people, regardless of actual or perceived sexual orientation or gender identity; and (2) the designation of LGBTQ Equality Day on June 26 to commemorate Supreme Court decisions handed down on that day in 2003, 2013, and 2015. The resolution also acknowledges the need for further legislation to ensure that people in the United States are free from all forms of discrimination on the basis of actual or perceived sexual orientation or gender identity.

This resolution addresses issues involving LGBTQI+ identifying people. Specifically, the resolution calls on the Department of State, the U.S. Agency for International Development, and other federal agencies to include the promotion of equal rights for LGBTQI+ identifying people in their work; condemns discrimination, persecution, and violence against LGBTQI+ identifying people; calls on governments across Europe and Eurasia to foster safe and equitable environments for all people; and urges the U.S. government to increase funding for LGBTQI+ human rights organizations in Europe and Eurasia.

Visitor Visa Wait Time Reduction Act This bill requires the Department of State to report to Congress on the average waiting time to get a visitor visa interview at each diplomatic or consular post.  For each post where the average waiting time is longer than 300 days, the State Department must temporarily reassign personnel at that post to shorten the waiting time.

Afghan Adjustment Act This bill expands eligibility for special immigrant visas to certain Afghan nationals (and accompanying spouse and children) and addresses related issues. The Department of Homeland Security may provide such visas to Afghan nationals who provided qualifying service as a member of the Afghan Air Force or other specified entities and meet eligibility requirements, such as passing a background check. Currently, special immigrant visas for Afghan nationals are generally only available to those who were employed by or on behalf of the U.S. government in Afghanistan. Such visas shall also be available to an Afghan national who is a qualifying relative of a veteran or member of the U.S. Armed Forces. The bill also modifies procedures for providing lawful permanent resident status to certain classes of Afghan nationals, such as by (1) providing a streamlined process with specified vetting requirements for certain individuals, including those who provided support to the U.S. government in Afghanistan; and (2) preserving the eligibility of certain battered spouses whose eligibility for such status stemmed from a marriage that has terminated. Furthermore, the Department of State (1) must respond to inquiries from Members of Congress about specific applications from Afghan nationals seeking special immigrant or refugee status; and (2) establish an office in Afghanistan to perform certain tasks, such as issuing visas, if no U.S. embassies are operational in Afghanistan. The President must establish a task force to develop and implement a strategy to assist Afghan nationals who qualify for admission to the United States.

Deter PRC Support to the Russian War Effort Act The bill authorizes the President to impose sanctions on persons associated with China for financial, material, or technological support contributing materially to Russia's military action in Ukraine.  The sanctions include, for example, blocking transactions in U.S. property and prohibiting U.S. entry visas.

Oligarch Assets for Ukrainian Victory Act of 2022 This bill authorizes the Department of Justice to transfer to the Department of State the proceeds of property that was seized pursuant to sanctions imposed on individuals and entities involved with certain Russian government activities (e.g., malicious cyber activities and interference in U.S. elections), to be used to provide assistance to Ukraine to remediate harms caused by Russian aggression towards Ukraine.

Safety From Violence for Healthcare Employees Act or the SAVE Act This bill establishes a new criminal offense for knowingly assaulting or intimidating hospital personnel during the performance of their official duties in a manner that interferes with their performance of the duties or limits their ability to perform the duties. Additionally, the bill authorizes grants to reduce the incidence of violence at hospitals, including violence or intimidation against hospital personnel in the performance of their duties.

Oligarch Asset Forfeiture Act This bill authorizes the seizure of assets belonging to certain sanctioned individuals (generally, those individuals subject to various sanctions related to activities of Russia) and for such assets to be sold and used to provide assistance to Ukraine.

Stopping Harmful Image Exploitation and Limiting Distribution Act of 2022 or the SHIELD Act of 2022 This bill establishes a new criminal offense related to the distribution of intimate visual depictions. Specifically, it makes it a crime to knowingly distribute (or intentionally threaten to distribute) an intimate visual depiction of an individual (1) with knowledge of or reckless disregard for the individual's lack of consent and reasonable expectation of privacy, and (2) without a reasonable belief that distributing the depiction touches a matter of public concern. A violator is subject to criminal penalties—a fine, a prison term of up to two years for each individual victim depicted, or both.

No Travel for Traffickers Act of 2022 This bill bars from the visa waiver program any country that allows individuals to obtain citizenship by making an investment in that country.
