Sen. Mike McLane

Resolves that in each biennium, Legislative Assembly shall appropriate from General Fund to Department of Veterans' Affairs amount that is no less than amount appropriated from General Fund to Department of Veterans' Affairs in biennium beginning July 1, 2015, as adjusted.

Appropriates moneys to Oregon Department of Administrative Services to increase size and diversity of group of court appointed special advocates.

Modifies procedures by which person convicted of felony initiates proceedings to obtain DNA testing. Directs State Court Administrator to develop forms for use during court proceedings on DNA test requests. Authorizes person requesting testing to file motion requesting property and evidence control and disposition records and other written materials relating to prior forensic testing. Modifies requirements of motion and accompanying documents for DNA testing. Requires person to serve district attorney with copy of all prior sworn statements of person concerning underlying prosecution. Modifies findings that, if made by court, require court to order DNA testing. Establishes findings that, if made by court, authorize court to order DNA testing. Creates procedures by which party seeking testing at certain laboratories may request court to order evaluation of laboratory in order for resulting DNA profile to be eligible for entry into state or national DNA index system. Provides that upon request to district attorney, victim has right to receive notice concerning DNA testing proceedings. Specifies when district attorneys must or may provide notification to crime victims.

Allows student to wear dress uniform issued by Armed Forces of United States during high school graduation ceremony if certain conditions are met. Declares emergency, effective on passage.

Provides that client has right to privately communicate with lawyer and representative of lawyer. Provides that evidence derived from privileged confidential communication is inadmissible in certain proceedings if confidential communication was obtained or disclosed without consent of client. Requires local correctional facilities and prisons to maintain one log for lawyers and representatives of lawyers visiting inmates and one log for all other persons visiting inmates. Requires all visitors to sign appropriate log. Provides that, unless exception applies, log for lawyers and representatives of lawyers is confidential, not subject to disclosure as public record and not subject to subpoena. Requires suppression of evidence derived from unlawful disclosure of log for lawyers and representatives of lawyers. ].

Imposes certain requirements related to private security providers who contract with or are employed by institutions of higher education to provide private security services on campus and special campus security officers commissioned by governing boards of public universities. Provides that private security professionals who provide private security services on campus and special campus security officers commissioned by governing board of public university do not have stop and frisk authority. Exempts retired member of Public Employees Retirement System from limitations on reemployment if member is reemployed by public university as special campus security officer or security officer for community college . Declares emergency, effective on passage.

Allows listed eastern Oregon counties that undertake economic opportunity analysis to designate up to 50 acres outside urban growth boundaries for industrial and other employment uses notwithstanding statewide planning goals related to agriculture, forest use or urbanization. Excludes high-value farmland. Requires county coordination with State Forester and nearby cities.
