Extends sunset for tax credit for crop donation. Increases percentage of wholesale price allowed as amount of credit. Applies to tax years beginning on or after January 1, 2019. Takes effect on 91st day following adjournment sine die.
Requires health care practitioner to exercise proper degree of care to preserve health and life of child born alive after abortion or attempted abortion. Requires health care practitioner to ensure child born alive is transported to hospital. Creates crime for failure to exercise proper standard of care, punishable by maximum of five years' imprisonment, $125,000 fine, or both. Allows specified person to bring civil action for damages and equitable relief against health care practitioner for failure to exercise proper standard of care. Directs court to award attorney fees to prevailing plaintiff. Allows court to order identity or personally identifiable information of specified person protected from disclosure.
Establishes Oregon Empowerment Scholarship Program for purpose of providing options in education to students of this state. Establishes qualifications for participation in program, qualified expenses under program and transfers of moneys made under program. Restricts number of students from each school district who may enroll in program for first 10 years. Establishes Department of Education Empowerment Account. Continuously appropriates moneys to Department of Education for payment of department's expenses under program. Establishes Treasurer Empowerment Account. Continuously appropriates moneys to State Treasurer for payment of treasurer's expenses under program. Establishes Oregon Empowerment Scholarship Account within State School Fund. Continuously appropriates moneys to Department of Education for purpose of making transfers under program. Declares emergency, effective on passage.
Appropriates moneys from General Fund to Oregon Watershed Enhancement Board for purposes related to programs for grants from Oregon Agricultural Heritage Fund. Declares emergency, effective July 1, 2019.
Prohibits full-service restaurant from providing single-use plastic straw to consumer unless consumer requests single-use plastic straw. Establishes that Oregon Health Authority or local public health authority shall enforce prohibition in course of inspecting full-service restaurant and impose civil penalty of not more than $25 per day after second violation. Caps total civil penalty at $300 per full-service restaurant during one calendar year.
Removes ability of parent to decline required immunizations against restrictable diseases on behalf of child for reason other than child's indicated medical diagnosis. Allows child who is not immunized or exempt for reason of indicated medical diagnosis to attend school that provides education program through online courses. Prohibits child from attending in-person ] in person specified school-related activities ] events, meetings and opportunities . Defines "restrictable diseases." Allows Oregon Health Authority to recommend additional diseases against which children may be immunized. Directs boards that regulate certain licensed health care practitioners to review documents completed by licensed health care practitioners granting exemptions from immunization requirements because of indicated medical diagnosis. Defines "licensed health care practitioner." Requires boards to report annually to authority on results of review. Requires authority to report annually to Legislative Assembly on reports submitted by boards. Directs Oregon Health ] authority to establish outreach and education plan regarding disease control in schools. Allows child who is not immunized to continue attending school in person until August 1, 2020. Declares emergency, effective on passage.
Prohibits abortion unless physician has first determined probable post-fertilization age of unborn child, except in case of medical emergency. Prohibits abortion of unborn child with probable post-fertilization age of 20 or more weeks, except in case of medical emergency. Requires physician who performs or induces, or attempts to perform or induce, abortion to file report, within 30 days, with Oregon Health Authority. Requires authority to publish annually statistics relating to abortion.
Requires Department of Human Services to administer program to make support service providers available to individuals who are deaf-blind. Describes program.
Directs Department of Education to prepare and make available statement that discloses potential health risks of wireless network technology. Requires department to adopt by rule guidelines for including in school curricula, assemblies, open houses, meetings between parents and teachers and related settings information concerning hazards of exposure to microwave radiation and radio frequency radiation and how to safely use wireless devices. Requires department and Oregon Health Authority to conduct study on effects of exposure to microwave radiation and radio frequency radiation, particularly exposure that results from use of wireless network technologies, on development and health of students in schools of this state, to develop recommendations to schools in this state for practices and alternative technologies that would reduce students' exposure to harmful microwave radiation and radio frequency radiation and report results of study and recommendations to interim committee of Legislative Assembly related to education not later than September 15, 2020. Declares emergency, effective on passage.
Changes qualification process for building officials and inspectors. Requires testing and evaluation of qualifications by independent accrediting entity based on comparison to nationwide or multistate standards. Requires issuance of license to qualified applicant except for specified reasons or other good cause. Authorizes appointment or employment of licensee as building official or inspector without further approval process. Applies to licenses applied for on or after January 1, 2021. Requires Director of Department of Consumer and Business Services to identify parts of plumbing specialty code and electrical specialty code appropriate for inspection by specialized building inspectors. Requires adoption of statewide standards for plan review, permits, inspections standards and procedures and certificates of occupancy. Establishes conditions for department adoption of temporary rules. Establishes conditions prohibiting or allowing building official or inspector performance of other professional services in regard to construction or property development. Revises definition of inspector to include service providers not employed by municipality. Allows holder of lapsed authorization as specialized building inspector regarding plumbing specialty code or electrical specialty code to obtain specialized building inspector license upon payment of license fee. Creates exception. Requires filing license application before January 1, 2022.
