Prohibits county from bringing claim or action against person if claim or action is based on statement in trust deed that nominee or agent of lender is grantee or beneficiary, based on county's recording or indexing instrument that states that nominee or agent of lender is grantee or beneficiary or based on person's having obtained or transferred interest in trust deed by means of instrument that was executed or delivered to person but was not recorded in county's deeds and mortgages records or in county's County Clerk Lien Record. Prohibits county clerk from charging or collecting fee for instrument that transfers interest in trust deed and that was executed and delivered to person but was not presented for recording. Applies to claims that arise before, on or after January 1, 2018, but does not apply to actions that commenced before January 1, 2018. Declares emergency, effective on passage.
Allows credit against net income taxes for portion of eligible costs of newly constructed single-family dwelling that sells for price affordable to household with annual income at or below 120 percent of area median income. Sunsets on January 2, 2028. Takes effect on 91st day following adjournment sine die.
Proposes amendment to Oregon Constitution to broaden definition of bills that raise revenue and thus require supermajority of both chambers. Defines "raising revenue" to include increase in any tax or fee, including bills that modify or eliminate exemptions, credits, deductions or lower rates of taxation. Refers proposed amendment to people for their approval or rejection at next regular general election.
Allows State Forester to order use of wildfire suppression personnel, equipment and services on any lands within state borders.
Creates Oregon Energy Commission as policy and rulemaking body for State Department of Energy. Transfers certain duties of State Department of Energy and Director of State Department of Energy to commission. Modifies state energy policy. Modifies general duties of department. Requires department to develop statewide strategic energy report ] plan . Requires commission to adopt report ] plan no later than January 1, 2021. Requires department to present draft report ] plan to Legislative Assembly no later than September 15, 2020. Requires commission to periodically review and update report ] revise plan . Provides that plan and any periodic revisions may not go into effect until January 1 following legislative session at which commission submits plan or revision to Legislative Assembly. Modifies biennial comprehensive energy report requirements. Transfers certain State Department of Energy programs to other agencies. Repeals certain State Department of Energy programs. Reduces, to 0.1 ] 0.15 percent, percentage of energy resource supplier's gross operating revenue that annual energy resource supplier assessment may not exceed. Changes calculated share of annual energy resource supplier assessment below which energy resource supplier is exempt from payment of assessment from $250 to $2,500. Modifies definition of "gross operating revenue" for purposes of energy resource supplier assessment. Applies to annual fees due on or after July 1, 2019. Requires State Department of Energy to study further restructuring of department. Requires department to present results of study to interim committee of Legislative Assembly no later than September 15, 2019. Sunsets study requirement on December 31, 2019. Becomes operative July 1, 2019. Declares emergency, effective on passage.
Directs Department of Veterans' Affairs to develop and implement one or more grant programs statewide to expand and enhance existing campus veteran resource centers and employ campus veteran resource coordinators on campuses of community colleges and public universities to help veterans successfully transition from military service to college life, succeed in college, complete educational goals and transition from college to workforce and community. Limits biennial expenditures from lottery moneys allocated from veterans' services fund to Department of Veterans' Affairs for purpose of implementing grant programs. Requires Department of Veterans' Affairs to submit report on grant programs to interim legislative committees relating to veterans by August 31, 2018. Requires Advisory Committee to report to interim legislative committees related to veterans with evaluation of grant programs and recommendations for legislation by September 15, 2018. Sunsets January 2, 2020. Declares emergency, effective on passage.
Requires State Forester to make any recreational opportunities in state forests free , upon showing of certain identification and documentation, for disabled veterans and for persons who are on leave from military active duty on certain holidays.
Establishes Willamette Falls Locks Commission as advisory body for issues relating to repair, reopening, operation, maintenance and future transfer of ownership of navigational canal and locks. Appropriates funds from General Fund to Higher Education Coordinating Commission for purposes of Act. Sunsets commission, program and account on December 31, 2023. Declares emergency, effective on passage.
Increases penalties for assault committed against flagger or highway worker who is performing official duties. Punishes by maximum of five years' imprisonment, $125,000 fine, or both. Declares emergency, effective on passage.
