Rep. Cyrus Javadi

Prohibits distributing, selling, attempting to sell or allowing to be sold inhalant delivery systems in this state unless the inhalant delivery systems are listed in a directory maintained by the Attorney General. Requires manufacturers of inhalant delivery systems who want the inhalant delivery systems to be listed in the directory to submit an annual certification to the Attorney General attesting to compliance with federal marketing authorization requirements. Imposes certification fees and penalties. Defines "alternative nicotine products" and adds those products to existing provisions that apply to other tobacco products. Clarifies licensing requirements for distributors and delivery sellers of tobacco products. Prohibits the sale of flavored inhalant delivery systems that contain nicotine or nicotine analogues and that have not received a marketing authorization order from the United States Food and Drug Administration. Establishes new age verification requirements for the sale of tobacco products. Expands authority to seize and destroy unlawful tobacco products. Declares an emergency, effective on passage.

Establishes the Rare Disease Advisory Council. Directs the council to biennially submit a report to the Governor and appropriate legislative committees summarizing the activities of the council and making policy recommendations.

Requires health insurance coverage of specified fertility services and treatments with exemption for certain insurers. Directs the Oregon Health Authority and the Department of Consumer and Business Services to study access to fertility and reproductive endocrinology services and report findings to the interim committees of the Legislative Assembly related to health. Declares an emergency, effective on passage.

Repeals the requirement that there be a licensed repository for the disposal of high-level radioactive waste before a site certificate for a nuclear-fueled thermal power plant may be issued. Repeals the requirement that a proposed site certificate for a nuclear-fueled thermal power plant be submitted to the electors of this state for their approval or rejection. Refers the Act to the people for their approval or rejection at the next regular general election.

Creates a procedure for a minor who is at least 14 years old to intervene and move the court to suspend or terminate the parenting time of parent against whom the Department of Human Services has substantiated an allegation of abuse.

Requires the Oregon Health Authority to study staffing plans for hospitals. Directs the authority to submit findings to the interim committees of the Legislative Assembly related to health care not later than September 15, 2026. Sunsets on January 2, 2027.

Enacts the interstate Counseling Compact. Allows the Oregon Board of Licensed Professional Counselors and Therapists to disclose specified information to the Counseling Compact Commission. Exempts individuals authorized to work as professional counselors under the Compact privilege to practice from the requirement to obtain a license from the board. Allows the board to use moneys to meet financial obligations imposed on the State of Oregon as a result of participation in the Compact. Becomes operative on January 1, 2028. Takes effect on the 91st day following adjournment sine die.

Limits the applicability of certain administrative rules relating to the siting, permitting or location of agricultural labor housing in connection with a livestock operation. Prohibits the Director of the Department of Consumer and Business Services from retroactively enforcing the rules with respect to certain agricultural housing unless there exists an immediate hazard to the health and safety of agricultural workers occupying the housing. Prohibits the director from adopting rules that require the relocation, modification or demolition of certain agricultural labor housing to comply with certain rules adopted on or after the effective date of this Act. Declares an emergency, effective on passage.

Provides that a health care facility is not a manufacturer, distributor, seller or lessor of a product for purposes of a product liability civil action if the health care facility was not involved in the design or manufacture of the product.

Creates the crime of initiating a false report in the first degree. Punishes by a maximum of 10 years' imprisonment, $250,000 fine, or both. Creates the crime of initiating a false report in the second degree. Punishes by a maximum of five years' imprisonment, $125,000 fine, or both. Renames the crime of initiating a false report to initiating a false report in the third degree. Takes effect on the 91st day following adjournment sine die.
