Establishes Elliott State Research Forest consisting of lands formerly constituting Elliott State Forest. Declares Oregon State University's Elliott State Research Forest Proposal accepted and amended by State Land Board. Provides for further amendments to proposal by university under certain circumstances. Creates Elliott State Research Forest Authority to administer Elliott State Research Forest. Provides that authority shall be governed by board of directors to which voting members are appointed by State Land Board. Describes duties of board of directors. Provides that board of directors constitutes governing body of authority for purposes of public meetings statutes. Describes duties and powers of State Land Board related to forest. Describes duties of executive director of authority. Describes powers of authority. Provides that requirements of public records statutes apply to authority. Provides that requirements of Administrative Procedures Act do not apply to actions of authority or board of directors. Creates exception allowing judicial review of action principally concerning person's individual rights. Creates exception allowing judicial review of certain other actions. Authorizes board of directors to request revenue bonding to be used for owning, operating or administering forest. Authorizes board of directors to request certain general obligation bonding to be used for owning and operating forest. ] Authorizes use of certificates of participation financing to finance capital projects or purchases related to owning, operating or administering forest. Directs State Forestry Department to procure services for development and application of landslide modeling. Establishes small forestland owner minimum options related to forest practices by small forestland owners. Directs board to adopt by rule Small Forestland Investment in Stream Habitat Program. Creates Small Forestland Owner Assistance Office within department. Establishes certain requirements and prohibitions related to beaver. Establishes Private Forest Accord Mitigation Advisory Committee. Directs State Fish and Wildlife Commission to establish by rule Private Forest Accord Grant Program. Directs board to establish by rule adaptive management program. Establishes Adaptive Management Program Committee and Independent Research and Science Team as advisory committees to board. Amends Oregon Forest Practices Act. Provides that policies do no affect treaty or other rights of Indian tribe or beneficial ownership interest of land held in trust for Indian tribe or held by Indian tribe ] certain property rights of Indian tribe or tribally owned or operated corporation . Authorizes department to adopt rules related to pesticide applications. Makes operability of new provisions and amendments contingent on issuance of incidental take permit on or before December 31, 2027, and incidental take permit remaining in effect. Appropriates moneys from General Fund to certain agencies for certain purposes. Increases certain limitations on expenditures. Declares emergency, effective on passage.
Establishes product stewardship program for mattresses. Establishes Mattress Stewardship Fund. Establishes mattress stewardship program advisory committee. Requires stewardship organizations to submit plans for mattress stewardship programs to Department of Environmental Quality. Imposes civil penalties for violation of program provisions not to exceed, per day for each day of violation, $100 for violation by retailer, $1,000 for violation by producer or renovator and $1,000 for violation by stewardship organization. Becomes operative January 1, 2023. Takes effect on 91st day following adjournment sine die.
Directs Oregon Business Development Department to develop and implement Economic Equity Investment Program to award grants to organizations that provide culturally responsive services to support economic stability, self-sufficiency, wealth building and economic equity among disadvantaged individuals, families, businesses and communities in Oregon. Becomes operative January 1, 2023. Appropriates moneys from General Fund to department for purposes of grant program. Takes effect on 91st day following adjournment sine die.
Directs Oregon Film and Video Office to establish Creative Opportunity Program to promote film, television, interactive, animation and media industries in Oregon. Dedicates two percent of moneys in Oregon Production Investment Fund to making payments to media industry entities for creation and funding of projects under program. Declares emergency, effective on passage.
Requires owners or operators of bulk oils and liquid fuels terminals located in Columbia, Multnomah or Lane County to conduct and submit to Department of Environmental Quality seismic vulnerability assessments. Requires department to review and approve seismic vulnerability assessments. Requires owner or operator of existing bulk oils or liquid fuels terminal to submit seismic vulnerability assessment by June 1, 2024. Requires department to submit report on seismic vulnerability assessments and make recommendations on expansion of program to interim committees of Legislative Assembly by November 1, 2024. Requires owner or operator of bulk oils or liquid fuels terminal to properly implement seismic risk mitigation implementation plan approved by department. Directs Environmental Quality Commission to, by rule, adopt seismic risk mitigation implementation program for bulk oils or liquid fuels terminals. Prohibits owner or operator of bulk oils or liquid fuels terminal from retaliating against employee who provides information regarding violation of law or safety risks. Establishes Seismic Risk Mitigation Fund. Requires State Department of Energy to develop energy security plan by June 1, 2024, and provide report on implementation or revision of plan to interim committees of Legislative Assembly by September 15 of each even-numbered year. Takes effect on 91st day following adjournment sine die.
Requires insurer and health care service contractor to cover labor and delivery services provided at out-of-network health care facility , and medical transport of individual presenting with signs of labor from in-network facility to out-of-network facility, if services provided at out-of-network facility due solely to diversion of patient from in-network health care facility for reasons related to state or federal declaration of public health emergency. Prescribes rate of reimbursement and prohibits deductible, out-of-pocket maximum, copayment or coinsurance requirement in excess of such requirements applicable to in-network providers. Exempts Public Employees' Benefit Board and Oregon Educators Benefit Board. Requires health benefit plan coverage of emergency medical services transport of pregnant woman presenting with signs of labor between medical facilities. ] Declares emergency, effective on passage.
Updates statutory references to individual who is not citizen or national of United States to replace "alien" with "noncitizen." Directs state agencies to use "noncitizen" in rules and regulations to reference individual who is not citizen or national of United States and to update rules and regulations that use "alien" to use "noncitizen." Authorizes agencies to amend rule without prior notice or hearing for purpose of changing term or phrase in order to conform with change made by law. Makes nonsubstantive changes.
Expands crime of assault in the third degree to include causing physical injury to person working in hospital while worker is performing official duties. Punishes by maximum of five years' imprisonment, $125,000 fine, or both. Declares emergency, effective on passage.
