Trust-Busting for the Twenty-First Century Act

Trust-Busting for the Twenty-First Century Act This bill makes various changes to the federal antitrust statutes and places restrictions on acquisitions involving certain dominant digital firms. First, the bill revises the evidentiary standards for establishing an illegal monopoly. Under the bill, if a plaintiff establishes the existence of substantial market power or the detrimental effects of particular practices, then the plaintiff need not further establish the scope of the relevant market or the share of the market controlled by the defendant. Further, to prove that the procompetitive effects justify a defendant's conduct the defendant must show by clear and convincing evidence that (1) the procompetitive effects of the conduct outweigh the anticompetitive effects, and (2) the defendant could not obtain substantially similar procompetitive effects through commercially reasonable alternatives. In the case of a violation, courts must order the disgorgement of all profits earned as a result of the conduct. Next, the bill generally prohibits acquisitions by companies with a market capitalization exceeding $100 billion where the effect of the acquisition may be to lessen competition. Finally, the Federal Trade Commission may designate as a dominant digital firm a website or online service that the commission determines possesses dominant market power based on specified factors. Acquisitions by such firms in excess of $1 million are presumed unfair trade practices under the bill. Further, a dominant digital firm that provides search functionality must disclose to users any search results are that are promoted or demoted based on whether the search result is affiliated or not affiliated with the firm.

A resolution remembering the 5th anniversary of the terrorist attacks at Brussels Airport and the Maalbeek metro station in Belgium and honoring the victims of the terrorist attacks.

This resolution remembers the fifth anniversary of the March 22, 2016, terrorist attacks in Brussels, Belgium. It also honors the memory of Justin Shults, Stephanie Shults, Gail Minglana Martinez, and Bruce Baldwin, the four Americans killed in the attacks, and expresses condolences to the other victims.

Keep China Out of Solar Energy Act of 2021

Keep China Out of Solar Energy Act of 2021 This bill prohibits federal procurement of solar panels manufactured or assembled in China. Specifically, the bill directs the Office of Management and Budget (OMB) to develop standards and guidelines for executive agencies to prohibit (1) federal funds from being awarded for the procurement of solar panels that are manufactured or assembled by any entity domiciled in China or subject to influence or control by the government of China or the Chinese Communist Party, and (2) the use of government-issued purchase cards to purchase solar panels that are manufactured or assembled by any such entity. The Federal Acquisition Regulatory Council shall amend the Federal Acquisition Regulation to implement the prohibition with respect to federal contracts and subcontracts. The bill sets forth provisions regarding waivers, quarterly reports by the OMB to Congress, and a report by the Government Accountability Office. The OMB shall seek to enter into a contract with a federally funded research and development center under which the center will study (1) the current and future domestic market of solar panel production, (2) the ability of the solar panel domestic market to keep pace with technological advancements across the industry, and (3) the current global supply chain and workforce involved with solar panel production.

Preventing SBA Assistance from Going to China Act of 2021 This bill prohibits the Small Business Administration from providing aid, counsel, or assistance to a small business concern that (1) is headquartered in China, or (2) has more than 25% of voting stock owned by citizens of China.

Fair Trade with China Enforcement Act

Fair Trade with China Enforcement Act This bill revises trade, finance, and tax provisions with respect to China. Specifically, the bill directs the Department of Commerce to prohibit the export of certain U.S. technology and intellectual property to China, and it places a shareholder cap on Chinese investments in certain U.S. corporations. The bill prohibits federal agencies from using or procuring telecommunications equipment or services from Huawei Technologies Company, ZTE Corporation, or any other entity reasonably believed to be owned or controlled by China. Further, the bill requires the U.S. Trade Representative to list certain Chinese products that receive support pursuant to China's Made in China 2025 policy. The bill expedites the countervailing duty process (i.e., the imposition of duties to offset a subsidy by a foreign government) for products on this list. The bill amends the Internal Revenue Code to (1) repeal certain reduced withholding rates for residents of China, and (2) provide for the taxation of income received by China on certain U.S. investments.

ROC Act

Reassurance On Commitments Act of 2021 or the ROC Act This bill prohibits using funds made available to the Department of State for FY2022 to implement or enforce any policy that restricts representatives of Taiwan (such as members of Taiwan's armed forces or representatives of its government) or the Taipei Economic and Cultural Representative Office from displaying symbols of Taiwan's sovereignty for official purposes.

A resolution condemning the crackdown by the Government of the People's Republic of China and the Chinese Communist Party in Hong Kong, including the arrests of pro-democracy activists and repeated violations of the obligations of that Government undertaken in the Sino-British Joint Declaration of 1984 and the Hong Kong Basic Law.

This resolution condemns the crackdown on pro-democracy activists carried out by the governments of Hong Kong and China and the Chinese Communist Party under the illegitimate and arbitrary pretext of national security. The resolution also states that the crackdown violates (1) the 1984 agreement between the United Kingdom and China relating to Hong Kong; and (2) Hong Kong's Basic Law, the territory's constitutional document.

College Transparency Act

College Transparency Act This bill requires the National Center for Education Statistics to establish a secure and privacy-protected data system that contains information about postsecondary students. Specifically, the data system must evaluate student enrollment patterns, progression, completion, and postcollegiate outcomes, and higher education costs and financial aid; provide complete and customizable information for students and families making decisions about postsecondary education; reduce the requirements for reporting by institutions of higher education; and periodically match with other federal systems of data. The bill also establishes a postsecondary student data system advisory committee.
