Rep. Robert C. "Bobby" Scott

This resolution calls for the creation of a Green New Deal with the goals of achieving greenhouse gas and toxic emissions reductions needed to stay under 1.5 degrees Celsius of warming; establishing millions of high-wage union jobs and ensuring economic security for all; investing in infrastructure and industry; securing clean air and water, climate and community resiliency, healthy food, access to nature, and a sustainable environment for all; and promoting justice and equality. The resolution calls for accomplishment of these goals through a 10-year national mobilization effort. The resolution also enumerates the goals and projects of the mobilization effort, including building smart power grids (i.e., power grids that enable customers to reduce their power use during peak demand periods); upgrading all existing buildings and constructing new buildings to achieve maximum energy and water efficiency; removing pollution and greenhouse gas emissions from the transportation and agricultural sectors; cleaning up existing hazardous waste and abandoned sites; ensuring businesspersons are free from unfair competition; and providing higher education, high-quality health care, and affordable, safe, and adequate housing to all.

Camp Lejeune Justice Act of 2021 This bill allows certain individuals to sue and recover damages for harm from exposure to contaminated water at Camp Lejeune in North Carolina between August 1, 1953, and December 31, 1987. This action is available only to individuals who were exposed to contaminated water for at least 30 days. The bill prohibits the U.S. government from asserting specified immunity from litigation in response to such a lawsuit. The bill also prohibits an individual who brings such an action from bringing a separate tort action against the United States based on the same harm.

Equal Access to Abortion Coverage in Health Insurance Act of 2021 or the EACH Act of 2021 This bill requires federal health care programs to provide coverage for abortion services and requires federal facilities to provide access to those services. The bill also permits qualified health plans to use funds attributable to premium tax credits and reduced cost sharing assistance to pay for abortion services.

Veterans Census-Enabled National Treatment Equitable Resource Supplement for Mental Health Act of 2021 or the Vet CENTERS for Mental Health Act of 2021 This bill requires the Department of Veterans Affairs (VA) to ensure the number of Vet Centers in certain states is increased by at least one additional center if the VA determines the state meets specified requirements. The VA must also establish a community-based outpatient clinic in each state that does not share a land border with another state, is located at least 2,000 miles from the contiguous United States, and contains no such clinic.

Revising and Expediting Actions for the Crisis Hotline for Veterans Act or the REACH for Veterans Act This bill requires the Department of Veterans Affairs (VA) to update training and procedures for call responders of the Veterans Crisis Line. Specifically, the VA must enter into an agreement with an outside organization to review the training for crisis line call responders. The VA must update the training if any deficiencies are identified after the review. Among other requirements, the VA must develop guidelines on retraining and quality management for when a call responder has an adverse event or needs improvement, annually perform a common cause analysis for identified callers to the crisis line who died by suicide in situations where the crisis line was the last point of contact, develop enhanced guidance and procedures to respond to calls to the crisis line related to substance use and overdose risk, review the current emergency dispatch standard operating procedure of the crisis line, and solicit feedback from veterans service organizations on how to conduct outreach regarding the move to 988 as the new suicide and mental health crisis hotline. Each call responder must be subject to at least two calls per month that are silently monitored by a supervisor to check for quality of conduct. The Veterans Crisis Line, Office of Mental Health and Suicide Prevention of the VA, and National Center for Patient Safety of the VA must establish quality management processes and expectations for staff of the crisis line.

Eliminating a Quantifiably Unjust Application of the Law Act of 2021 or the EQUAL Act of 2021 This bill eliminates the federal sentencing disparity between drug offenses involving crack cocaine and powder cocaine. Currently, different threshold quantities of crack cocaine and powder cocaine (e.g., 28 grams of crack cocaine and 500 grams of powder cocaine) trigger the same statutory criminal penalties. This bill eliminates the lower quantity thresholds for crack cocaine offenses. Under the bill, the same threshold quantities of crack cocaine and powder cocaine trigger the same statutory criminal penalties. The change applies to future cases and cases pending on the date of enactment. With respect to past cases, the bill authorizes a sentencing court to impose a reduced sentence on a defendant who was convicted or sentenced for a specified crack cocaine offense before this bill's enactment. A defendant does not have to be present at the sentence reduction hearing. Finally, the bill prohibits the reduction of a sentence that was previously reduced.

EMBRACE Stormwater Management Act or the Enhancing Military Base Resilience And Conserving Ecosystems through Stormwater Management Act This bill authorizes the Department of Defense and each military department to implement stormwater management projects on or related to military installations. Specifically, such projects are authorized for the purpose of (1) protecting nearby waterways and stormwater-stressed ecosystems, and (2) improving military installation resilience or the resilience of a defense access road or other essential civilian infrastructure supporting the installation.

John R. Lewis Voting Rights Advancement Act of 2021 This bill establishes new criteria for determining which states and political subdivisions must obtain preclearance before changes to voting practices may take effect. Preclearance is the process of receiving preapproval from the Department of Justice (DOJ) or the U.S. District Court for the District of Columbia before making legal changes that would affect voting rights. A state and all of its political subdivisions shall be subject to preclearance of voting practice changes for a 10-year period if 15 or more voting rights violations occurred in the state during the previous 25 years; 10 or more violations occurred during the previous 25 years, at least 1 of which was committed by the state itself; or 3 or more violations occurred during the previous 25 years and the state administers the elections. A political subdivision as a separate unit shall also be subject to preclearance for a 10-year period if three or more voting rights violations occurred there during the previous 25 years. States and political subdivisions that meet certain thresholds regarding minority groups must preclear covered practices before implementation, such as changes to methods of election and redistricting. Further, states and political subdivisions must notify the public of changes to voting practices. Next, the bill authorizes DOJ to require states or political subdivisions to provide certain documents or answers to questions for enforcing voting rights. The bill also outlines factors courts must consider when hearing challenges to voting practices, such as the extent of any history of official voting discrimination in the state or political subdivision.

Harlem Hellfighters Congressional Gold Medal Act This bill provides for the award of a Congressional Gold Medal to the 369th Infantry Regiment, commonly known as the Harlem Hellfighters, in recognition of their bravery and outstanding service during World War I.

Migratory Bird Protection Act of 2021 This bill prohibits the incidental taking (e.g., capturing or killing) of migratory birds by commercial activities unless the activity is authorized under a permit or is identified as posing de minimis risk to migratory birds. The U.S. Fish and Wildlife Service (USFWS) must regulate such incidental taking, including by (1) issuing general permits for certain industries, (2) creating a mitigation fee for any incidental taking of migratory birds, and (3) identifying categories of de minimis risk activities that are exempt from liability for the taking of migratory birds. In addition, the USFWS must establish and maintain a research program (1) to evaluate the impacts of commercial activities on birds, (2) to evaluate the effectiveness of best management practices and technologies to avoid or minimize such impacts, and (3) to develop new or improved best management practices and technologies.
