Lawless Cities Accountability Act of 2021 This bill prohibits federal funding for a jurisdiction that is a lawless jurisdiction. The term lawless jurisdiction means a state or political subdivision of a state that does one of the following: forbids law enforcement from intervening to restore order during widespread violence or destruction, withdraws law enforcement protection from an area or structure that law enforcement officers are lawfully entitled to access, disempowers or defunds law enforcement agencies, or refuses to accept law enforcement assistance from the federal government amid widespread violence or destruction.
One In, Two Out Act This bill requires federal agencies to repeal certain existing rules prior to issuing a new rule. Specifically, the bill prohibits an agency from issuing a rule that imposes a cost or responsibility on a nongovernmental person or a state or local government unless it repeals two or more related rules. Additionally, an agency may not issue a major rule that imposes such a cost or responsibility unless (1) the agency has repealed or revised two or more related rules, and (2) the cost of the new rule is less than or equal to the cost of the rules being repealed or revised. (Generally, a major rule is one likely to result in an annual economic impact of $100 million or more, a major increase in costs, or significant adverse effects on competition or investment.) Any such repealed or revised rule must be published in the Federal Register. This bill does not apply to a rule or major rule that (1) relates to an internal agency policy, (2) procurement by the agency, or (3) is being revised to be less burdensome by decreasing requirements imposed or compliance costs.
No Communist Countries Participating in Lobbying Act This bill prohibits former Members of Congress from lobbying the federal government on behalf of communist countries (or entities that are owned or controlled by such countries) and establishes specific monetary penalties for violations.
Protecting Our Kids from Harmful Research Act This bill prohibits the use of federal funds for research or publications concerning gender transitions in individuals under the age of 18.
This bill prohibits withholding federal education funds from an otherwise eligible recipient (e.g., educational agencies, schools, and institutions of higher education) because the recipient does not require students or employees to be vaccinated against COVID-19.
Equal Treatment of Public Servants Act of 2021 This bill phases in a new funding formula for determining benefit amounts under the windfall elimination provision (WEP). The WEP reduces Social Security retirement and disability benefits for those who receive pensions for certain non-covered employment. The new formula adjusts an individual's total lifetime earnings based on the proportion of those earnings subject to Social Security payroll taxes. It applies to individuals who (1) become eligible for Social Security benefits after 2061, and (2) have earnings from non-covered service performed in a year after 1977. Beneficiaries who become eligible for benefits between 2023 and 2061 receive the higher of their benefit calculated under the existing WEP or the new formula. In addition, certain beneficiaries currently impacted by the WEP receive an additional payment. The Social Security Administration must include non-covered earnings in Social Security account statements and must study the feasibility of partnering with certain pension systems to address data sharing issues related to non-covered pensions.
National Patient ID Repeal Act This bill repeals the requirement that the Department of Health and Human Services adopt a standard unique health identifier for each individual, employer, health plan, and health care provider. The provision has not been implemented to date because language included in annual appropriations acts has prohibited the use of federal funds for developing a unique identifier. However, some appropriations bills introduced in recent years have not included this funding restriction.
Nullify Occupational Safety and Health Administration Act or the NOSHA Act This bill abolishes the Occupational Safety and Health Administration (OSHA). OSHA, which is part of the Department of Labor, sets and enforces workplace safety and health standards and provides related training, outreach, education, and assistance.
