Conforms and improves the process for determining incapacity

Maddy summaryThis bill (A 7413) updates New York's process for determining a patient's incapacity to make healthcare decisions, specifically for life-sustaining treatment decisions. It requires an initial determination by a treating doctor, followed by a separate concurring determination by another qualified healthcare professional (like a nurse practitioner or specialist), to confirm the patient lacks capacity. The bill specifies different qualifications for the concurring reviewer based on whether incapacity stems from mental illness (requiring a psychiatrist) or developmental disability (requiring specialized training or experience). These determinations must be documented in the patient's medical record, and a patient's appointed healthcare agent cannot make the capacity determination. It directly affects hospitals, healthcare facilities, and medical staff involved in end-of-life care decisions.

Relates to Tier 1 high tax aid apportionment and foundation aid

Maddy summaryThis bill updates New York State's school funding formulas for high-tax districts. It establishes new regional cost indices (like 1.314 for Hudson Valley) based on non-education labor market wages to adjust foundation aid calculations. For Tier 1 districts (those with high property taxes), it sets aid at the higher of either $450 per student multiplied by the state ratio or $100,000, ensuring no district receives less than prior entitlements. The changes apply immediately to school funding starting with the 2025-2026 school year.

It directly affects redemption center operators who collect, sort, and package empty containers for return. The fee must be adjusted annually based on increases to New York's or federal minimum wage (whichever is higher), rounded to the nearest $0.005, starting December 31, 2025. The fee cannot be tied to purchasing goods/services or paid from refund value funds.

Relates to authorizing community colleges offering an associates degree program in nursing to offer a four-year bachelors degree program in nursing

Maddy summaryThis bill allows community colleges that currently offer associate degree nursing programs to also provide four-year bachelor's degree nursing programs. It directly affects these community colleges and their nursing students by expanding educational pathways without requiring separate state approval. The key provision amends education law to remove existing barriers, stating community colleges may offer the four-year degree "notwithstanding any other law, rule or regulation." This creates a clear legal mechanism for colleges to expand nursing education at their campuses. The bill is pending in the Higher Education committee as of March 2025.
