Directs the director of the budget to amend the state's overtime compensation eligibility policy to include all positions allocated up to and including salary grade 23.
Provides that recovery of wages due to a clerical error by the employer or vendor of the employer is prohibited if such clerical error did not result in an overpayment or other inaccuracy in the amount of wages paid or the time in which wages were dispersed.
Requires employers to pay employees who are manual workers no less than semi-monthly; provides that there is no civil penalty against an employer by an employee who unknowingly violates such provisions; authorizes the commissioner to levy a civil penalty against employers who violate such provisions.
This bill changes how final average salary is calculated for Triborough Bridge and Tunnel Authority employees in New York City's retirement system. It creates an alternate calculation method for employees whose service includes the period from March 2020 to December 2021, allowing their final average salary to include a projected overtime amount based on their 2022 pay. Employees using this method must pay back any missing retirement contributions for the projected overtime, but only for overtime not already paid for or previously contributed to. The New York City Retirement System must provide written estimates of the adjusted benefit and required contributions within 60 days of a member's request.
