Enacts the "sustainable affordable housing and sprawl prevention act"; exempts or limits environmental review under SEQR for the construction of certain new residential units to avoid creating unnecessary housing sprawl; limits certain rights to action under SEQR; makes related provisions.
This bill requires local social services districts to set shelter allowances at up to 100% of the U.S. Department of Housing and Urban Development's (HUD) fair market rent (FMR) for a recipient's unit size in their district. It directly affects low-income housing recipients who receive shelter assistance through local social services districts. The key provision mandates that allowances cover the recipient's actual rent obligation, capped at HUD's current FMR for their specific area and unit size. This change ensures assistance aligns with local rental market rates rather than fixed or lower rates. The bill takes effect 30 days after enactment.
Establishes a housing infrastructure tax credit to provide a credit of up to ten percent of costs for infrastructure projects related to the construction of new homes or multiple dwellings commenced and completed within a specific time period.
Relates to rental discrimination based upon consumer credit history; prohibits a person from refusing to rent or lease or otherwise to deny to or withhold from any person or group of persons housing accommodations because of the consumer credit history of such person or persons, or to represent that any housing accommodation is not available for rental or lease when in fact it is so available; defines consumer credit history.
Provides for the use of common areas in housing authority projects by tenant groups, committees or organizations without the imposition of a fee providing that the meeting is peacefully conducted, during reasonable hours, does not obstruct any access, and the space is reserved three days in advance.
Provides for free legal representation in certain mortgage foreclosure actions where the homeowner is financially unable to obtain counsel; requires notice of such availability.
Establishes the New York State social housing development authority as a public benefit corporation to increase the supply of permanently affordable housing in the state through the acquisition of land and renovation or rehabilitation of existing real property, and through the construction of new, permanently affordable housing.
